In short

Practitioners on secondment often keep home-country partnership income while acquiring host-country employment income, and partnership income is allocated by rules that do not follow the individual's movements.

Further down: the governing rule, the first-call questions, two completed files with figures, the way the work runs, and where the fee is published.

The rule that applies to this group and not the one next to it

Practitioners on secondment often keep home-country partnership income while acquiring host-country employment income, and partnership income is allocated by rules that do not follow the individual's movements.

Start with the mechanism, not the form. The difference between the two outcomes is a provision most people in this position have never heard of — and once it is identified, the rest of the file is straightforward.

Fixed fees for auditors & accountants abroad tax, agreed up front

For auditors and accountants on secondment abroad the fee is decided by what sits alongside the salary: a partnership share allocated at home while a host country taxes the employment income means two sets of figures to reconcile rather than one, and the allocation statements often arrive after the return is due. Quoted in writing first.

Three things we hear on the first call

  • My partnership share and my secondment salary are taxed by different countries.
  • I am seconded for two years and my home partnership keeps allocating me income.
  • My professional body's residency assumptions do not match my tax position.

Every one of those is a question we answer weekly. They arise because two tax systems were written independently and neither was designed with the other in mind. See also Canadian snowbird — the substantial presence test.

A worked example

This is what the rule produces when you put figures through it.

Equity that vests after the move

A grant worth C$141,000 at vest, over a 40-month vesting period, 15 months of which were worked in the first country and 25 in the second.

Equity that vests after the move
ItemAmount
Value at vestC$141,000
Vesting period (months)40
Months worked in the first country15
Months worked in the second country25
Apportioned to the first countryC$52,875
Apportioned to the second countryC$88,125

Two countries tax slices of one gain: C$52,875 and C$88,125 on this apportionment. Where their taxing points differ — grant, vest, exercise or sale — the credit can arrive in a year the other country is no longer taxing, which is the mismatch to plan around. That is an illustration of the mechanism, not a prediction about your file — the same computation on your figures is the first thing we do.

Illustrative figures, not a client engagement: the amounts are chosen to make the mechanism legible, and the rates and thresholds are assumptions stated for the example only. We confirm every one of them against the issuing authority for your own tax year before anything is filed.

Worked through with figures

It is easier to see with numbers attached.

Credit relief on one stream of income

Take C$76,000 of income taxed in both countries. Assume the other country charged 26% on it and the home country would charge 30% on the same amount.

Credit relief on one stream of income
ItemAmount
Income taxed in both countriesC$76,000
Tax paid abroad (assumed 26%)C$19,760
Home tax on the same income (assumed 30%)C$22,800
Credit available (lesser of the two)C$19,760
Home tax still payableC$3,040

The credit absorbs C$19,760 and leaves C$3,040 payable at home, because the home rate on this income is the higher of the two. The balance is real cash and it is due on the home timetable, which is why instalments get raised in the first meeting. We run this on your actual numbers before advising anything, because the conclusion can invert with a modest change in inputs.

Example figures throughout, selected to make the rule visible, with rates and thresholds assumed for the demonstration. Your actual filing uses figures confirmed with the issuing authority for your tax year.

How we handle it

  1. 1We establish what happened and when, because every position here is anchored to a date
  2. 2A written scope and a fixed price, so you know the cost before committing
  3. 3The filings are prepared, cross-checked against each other, and reviewed by name
  4. 4You see the result, approve it, and we file it
  • Your existing accountant keeps the domestic file; we take the cross-border piece, with the boundary in writing.
  • A 24-hour helpline, +1 (416) 619-0068, before you commit to anything.
  • A named reviewer signs off every statutory filing.

Your next step

Ask before the move rather than after it, because most of the useful options expire on the date.

International tax accountant — what this page covers

The subject here is cross-border tax for auditors & accountants abroad, which is what people mean when they search for international tax accountant. This page covers who it applies to, the filings it produces, and the fixed fee agreed before work begins.

How the engagement runs, phase by phase

  1. Documents first, questions second

We read the file before asking anything, so the questions we do ask are the ones that matter.

  2. A quote you can hold us to

Fixed in writing against a defined scope. No hourly meter, and no revision after the fact.

  3. The order of filing decided deliberately

Which return goes first can decide whether relief is available at all. That is planned, not discovered.

  4. Nothing filed without your sign-off

You see the completed work, ask what you need to, and approve it before submission.

The vocabulary this page leans on

Arbitration clause
A treaty provision allowing an unresolved mutual agreement case to be referred to binding arbitration. It exists in some treaties and not others.
Controlled foreign affiliate
A foreign affiliate controlled by the Canadian taxpayer, alone or with related parties, whose passive income can be attributed to the shareholder currently.
First-time penalty abatement
An administrative US waiver of certain penalties for a filer with an otherwise compliant history, requested rather than granted automatically.
Non-resident alien
A US tax classification for someone who is neither a citizen nor a resident under the green-card or presence tests. Non-resident aliens are taxed on US-source income and on income connected with a US business.

The length of the posting is the other lever. A secondment that runs across more than one tax year usually needs the residency position reassessed at both ends, and an accountant who has been abroad for several years with nothing filed at home is a catch-up engagement rather than a single return.

Why choose Legal Quotient for auditors & accountants abroad tax

You deal with the person who did the work

The practitioner who prepared and reviewed your file is the one who answers the question about it.

A named reviewer on every file

Every page on this site and every file we deliver says which practitioner reviewed it — a person, not a team inbox.

The order of filing is planned, not improvised

Which return goes first decides whether relief can be claimed at all. That sequence is worked out before anything is submitted.

One team, not two firms billing separately

You are not the go-between for two sets of advisers with two sets of assumptions. One engagement covers each country the file touches.

The engagement, start to finish

  • Step 1: Start with a conversation about the facts – Dates, residence, where the income arose. Fifteen minutes is usually enough to know what applies.
  • Step 2: Scope and price, both written down – You get the scope and the fixed fee together, so there is no question later about what was included.
  • Step 3: Prepared by one team, reviewed by a named practitioner – The same people see both sides of the file, and the reviewer signs their name to it.
  • Step 4: Filed, then followed through – Submission is not the end of the engagement — the queries that arrive afterwards are part of it.

What these engagements turn on

Case study 1

A Residency Determination Review After Leaving the Country

Residence is decided on ties, not on a form, and the review asks for evidence of every one of them. The file assembles the ties that were severed and the ones that remained, and answers the questionnaire against the treaty rather than around it.

Case study 2

Paid for Work Done in Canada While Living Elsewhere

Employment carried out in Canada is taxable here even where the employer and the bank account are not. The engagement establishes how many of the days were worked in Canada, applies the treaty employment article, and deals with the withholding the payer has already taken.

Read how this one runs
Case study 3

A Secondment Whose Paperwork Decided the Tax

Who employs, who directs and who bears the cost are the facts a treaty article turns on, and an assignment letter is where they are recorded. Drafting it with the tax position in view prevents an argument later.

Case study 4

Coming Back to Canada After Years Abroad

Returning restarts Canadian residence and re-values what you own on the day you arrive. Foreign pensions, employer plans and accounts opened abroad each land differently, and the reporting thresholds are tested against the whole portfolio rather than each account.

Read how this one runs
Case study 5

The Two-Year Window After Returning to India

Returning residents pass through a transitional status in which foreign income is largely outside the Indian net. The engagement establishes when the window opens and closes, and puts the transactions that benefit inside it.

Case study 6

Whether the Year Made Someone an NRI

Indian residence is decided by presence tests applied to the financial year, and a single trip can change the answer for the whole of it. The status is established before any return or exemption is considered.

Case study 7

An IRS Notice for a Year the Client Believed Was Settled

Most notices are proposals rather than assessments, and they carry a response window that is shorter than it looks. The engagement reads what is actually being proposed, gathers the support, and replies inside the window with the position rather than a request for time.

Case study 8

An Assignment Priced Without Counting the Days

Nearly every relief in a mobility file — treaty exemption, residence, social security — is decided by a day count that has to be evidenced. The engagement puts the tracking in place at the start, because it cannot be reconstructed at the end.

Core International & Cross-Border Tax Services

International Tax Planning & Advisory

Strategy and compliance for income, assets and families spread across borders.

One coordinating team: filings on every side of the border are sequenced so treaty relief and foreign tax credits are claimed once — and in the right country.

U.S. & Cross-Border Tax Returns

Dual filers: U.S. citizens in Canada and Canadians with U.S. income run two parallel systems — we prepare both, in the right order, every year.

Expat & Emigration Tax

The move year is its own project: the elections and valuations filed that year decide the next decade of both countries’ returns.

Non-Resident Canadian Tax

Default withholding is 25% of gross: elective returns routinely turn over-withheld rent and pensions into refunds.

Transfer Pricing & BEPS

Documentation prepared with the return is the cheapest insurance in international tax; reconstructing it during an audit is the most expensive.

Cross-Border Estates & Trusts

Wills drafted for one country routinely misfire in the other — deemed disposition here, estate tax there, credits in between.

Cross-Border Corporate Tax

Expansion raises the same four questions every time — entity, PE, repatriation, payroll. We answer them before the tax authorities do.

India Tax for NRIs & Returning Residents

The deduction is taken on the sale price, not the gain — which is why an NRI property sale strands cash unless the certificate is applied for before closing.

Canadian Tax with a Foreign Element

Residency is decided on facts, not on a form — and the year you arrive or leave is the one where the largest amounts turn on the smallest details.

UAE Tax for Expats & Their Home Country

A zero-tax country is only half the answer — the question that decides the bill is whether the country you came from still treats you as resident.

Software revenue crosses borders by default — sourcing rules, withholding on licence-like payments and IP location decide the effective rate.

Software revenue is rarely taxed where the team sits. Licence, subscription and service income are characterised differently by each side, and the answer decides withholding at source, treaty relief and whether a foreign customer creates a taxable presence at all — questions that are cheap to settle before the contract and expensive afterwards.

Tax for auditors & accountants abroad — questions we are asked

What makes auditors & accountants abroad different from an ordinary filing?

Practitioners on secondment often keep home-country partnership income while acquiring host-country employment income, and partnership income is allocated by rules that do not follow the individual's movements. An ordinary preparer applies the general rule and stops there, which is how the relief in the specific provision goes unclaimed.

Can you work with my existing accountant?

That is how most of these engagements run. They keep the domestic file, we take the cross-border piece, and the boundary is agreed in writing so nothing is done twice or missed.

What is expat tax?

Not a separate tax — it is the ordinary tax of one or more countries applied to someone living outside the one that claims them. In practice it means two systems at once: the filing your home country still requires, the filing the country you live in requires, and the relief provisions that stop the same income being taxed twice at full rates. What makes it specialist work is that the relief has to be claimed in the right country, in the right order. See our expat filing work.

Is "fund transfer pricing" the same thing as transfer pricing?

No — and if you came here to calculate FTP, this is not it. Fund transfer pricing is a bank's internal allocation of funding costs and benefits between its own business units, a treasury and asset-liability management discipline used to measure branch or product profitability. Tax transfer pricing is about prices between legally separate related parties across borders, and about which country taxes the resulting profit. The words overlap; the fields do not. See our transfer pricing work.

Can you review something another adviser prepared?

Yes, and that is a common engagement. A second opinion on a filed cross-border return most often finds an unclaimed credit, a missed information return, and a treaty position taken without the required disclosure.

Do you give a written opinion?

Where the position warrants one, yes — with the reasoning, the authority relied on, and what would change the answer. It is quoted as part of the scope rather than added afterwards.
