What moves you up a tier

What adds cost

Two things, mostly: reconstruction and waiting. Reconstruction is rebuilding a year from bank statements because the records are gone; waiting is a certificate or a slip that has to come from a tax authority or a foreign institution before we can file. We tell you which of the two is in play at the quote stage rather than at the invoice stage.

That a report is a report. A file that cannot be reconciled to the accounts is worse than a short one that can, and the rejection log is what an auditor actually reads.

Importer of record
The party legally responsible for an import, and therefore the party that can recover the import tax. Naming the wrong one strands the recovery.
Grantor trust
A trust whose income is taxed to the settlor rather than to the trust or beneficiaries, because of powers or interests the settlor retained.
Dependent agent
A person who habitually concludes contracts, or plays the principal role leading to them, on behalf of a foreign enterprise — creating a taxable presence without premises.
Section 116 clearance
The certificate the CRA issues on a non-resident's disposition of taxable Canadian property, without which the purchaser holds back part of the price.

Performance income is taxed where the performance happens, and the deduction is usually taken at source on the gross fee before expenses. What would make transfer pricing — local file cost more than the standard tier?

The number of transaction types. Goods, services, royalties and financing are four analyses rather than one, and each needs its own method and its own comparables.

Is the fee really fixed?

Yes, for the scope quoted. If the scope changes — another year appears, an entity turns up, a certificate becomes necessary — we re-quote before doing the work, so there is never an invoice you have not already agreed to.

What is transfer pricing?

The meaning of transfer pricing is narrow and specific: it is how related companies in a group price what they sell each other — goods, services, financing, the use of intellectual property. Tax law requires those prices to be what independent parties would have agreed, the arm's length principle, so profit is not simply moved to a lower-taxed country. Canada tests it under s.247, the US under s.482, India under s.92, and each expects documentation prepared contemporaneously. See transfer pricing documentation.

What is a transfer pricing policy, and is it the same as documentation?

No. The policy is the forward-looking statement of how your intercompany prices are set — which method for which transaction, which comparables, what happens when margins drift. The documentation is the backward-looking evidence that the policy was applied and produced an arm's length result for that year. Authorities read both, and a policy that the intercompany invoices do not actually follow is worse than none, because it establishes what you knew you should have done. What is OECD Pillar One?

The part of the international agreement that reallocates a share of taxing rights over the very largest and most profitable groups to the jurisdictions where their customers and users are, regardless of physical presence — plus a simplified approach to routine marketing and distribution returns. It is aimed at the digitalised economy problem that physical-presence rules could not reach, and its implementation is still moving, which is why we read the current instrument rather than the original blueprint.
