In short

A fund's tax profile is set by its vehicle, its investors' residence and the treaty entitlement of the entity that actually holds the assets — and anti-abuse tests now examine that entity's substance.

Further down: the governing rule, the first-call questions, two completed files with figures, the way the work runs, and where the fee is published.

The rule that applies to this group and not the one next to it

A fund's tax profile is set by its vehicle, its investors' residence and the treaty entitlement of the entity that actually holds the assets — and anti-abuse tests now examine that entity's substance.

The rule underneath it looks like this. The difference between the two outcomes is a provision most people in this position have never heard of — and once it is identified, the rest of the file is straightforward.

Transparent, fixed pricing for investment funds cross border tax

For an investment fund the fee follows the structure: how many jurisdictions your investors report from, and whether the holding entity's treaty entitlement has to be stress-tested and its substance evidenced rather than simply confirmed. A single vehicle with one class of investor is a narrower piece of work. Quoted in writing before we begin.

Three things we hear on the first call

  • Our holding entity's treaty access has never been stress-tested.
  • Our investors are in several countries with different reporting needs.
  • Our management and performance fees cross borders with no pricing support.

None of those is unusual and none of them is a reason to be embarrassed. They are the normal consequence of a system that asks an individual to reconcile two sets of rules that were never designed to fit together. See also tax risk register for cross-border groups.

A worked example

Worked through with figures, the mechanism looks like this.

Gross withholding against a net-basis return

A non-resident receives C$27,000 in the year. Assume withholding at 25% on the gross amount, and assume deductible costs of C$16,200 against it.

Gross withholding against a net-basis return
ItemAmount
Gross amount receivedC$27,000
Withheld at source (assumed 25% of gross)C$6,750
Deductible costsC$16,200
Net amount actually earnedC$10,800
Tax on the net amount (assumed graduated result)C$2,808
Difference recoverable by filingC$3,942

Filing on a net basis recovers C$3,942 of the C$6,750 withheld. That difference is the entire reason the elective return exists, and it is lost by not filing. That is an illustration of the mechanism, not a prediction about your file — the same computation on your figures is the first thing we do.

Example figures throughout, selected to make the rule visible, with rates and thresholds assumed for the demonstration. Your actual filing uses figures confirmed with the issuing authority for your tax year.

Worked through with figures

The same point, with figures rather than adjectives.

Credit relief on one stream of income

Take C$126,000 of income taxed in both countries. Assume the other country charged 26% on it and the home country would charge 41% on the same amount.

Credit relief on one stream of income
ItemAmount
Income taxed in both countriesC$126,000
Tax paid abroad (assumed 26%)C$32,760
Home tax on the same income (assumed 41%)C$51,660
Credit available (lesser of the two)C$32,760
Home tax still payableC$18,900

The credit absorbs C$32,760 and leaves C$18,900 payable at home, because the home rate on this income is the higher of the two. The balance is real cash and it is due on the home timetable, which is why instalments get raised in the first meeting. That is an illustration of the mechanism, not a prediction about your file — the same computation on your figures is the first thing we do.

The figures here are an illustration, not an engagement: amounts are picked so the mechanism is easy to follow, and every rate or threshold is an assumption of the example. Before anything is filed for you, each one is confirmed with the issuing authority for your own tax year.

What working with us looks like

  1. 1We establish what happened and when, because every position here is anchored to a date
  2. 2A written scope and a fixed price, so you know the cost before committing
  3. 3The filings are prepared, cross-checked against each other, and reviewed by name
  4. 4You see the result, approve it, and we file it
  • Documents move through an access-controlled portal rather than email.
  • Consultations scheduled to your working day rather than ours.
  • Authorisation with each authority, so we see the assessments and slips directly rather than asking you for them.

Your next step

If that describes your position, the next step is a short call — not a form.

Reviewed against current guidance for the 2025 and 2026 filing seasons by Udit Gupta, Cross-Border Tax Expert, Legal Quotient Consultants. This is general information rather than advice about your file — a short call is the way to get the second.

Cross border taxation — what this page covers

If you came here for cross border taxation, this is where it is dealt with. The subject is cross-border tax for investment funds, and the page covers who it reaches, what then has to be filed, and what we charge to do the work.

How the engagement runs, phase by phase

  1. Start with a conversation about the facts

Dates, residence, where the income arose. Fifteen minutes is usually enough to know what applies.

  2. Scope and price, both written down

You get the scope and the fixed fee together, so there is no question later about what was included.

  3. Prepared by one team, reviewed by a named practitioner

The same people see both sides of the file, and the reviewer signs their name to it.

  4. Filed, then followed through

Submission is not the end of the engagement — the queries that arrive afterwards are part of it.

The difference a dedicated cross-border team makes

Factor Legal Quotient Hourly billing model
Pricing A fixed fee, agreed in writing before work starts Hourly, billed as incurred
Experience 15+ years of cross-border work, 18,000+ clients Varies by file
Both sides of the border Prepared together by one team, so relief is claimed exactly once One country at a time, reconciled later
Who reviews it A named practitioner, published on the page Whoever the queue reaches
Where the work happens Our offices in India, the USA, Canada and the UAE Whichever single office you can travel to

The vocabulary this page leans on

Part XIII tax
Canada's flat withholding on passive payments to non-residents — rent, dividends, interest, pensions, royalties — which a treaty may reduce if the eligibility declaration is on file.
Mutual agreement procedure
The treaty process by which two competent authorities resolve a case of double taxation, available even where domestic appeal rights have run.
Preparatory or auxiliary
The carve-out that keeps genuinely supporting activity from creating a permanent establishment. It is narrow, and it is tested on what is actually done.
Specified foreign financial asset
The class of asset reportable on the US FATCA statement: foreign accounts, foreign-issued securities, interests in foreign entities and certain foreign contracts.

The published fees closest to investment funds cross border tax

Fee flows are the other half of a fund engagement: management and performance charges crossing a border need pricing support, and building that support from partnership agreements for the first time is a longer exercise than updating it for a new period. The number of entities in the chain decides which.

What working with us on investment funds cross border tax looks like

Every figure on a page is traceable

Where a rate or a threshold appears in our writing it names the tax year it belongs to. Where it could not be confirmed, the page describes the mechanism and quotes no number.

Filed with the authority, not just prepared

The engagement runs to submission and to the correspondence that follows it, including the queries that arrive months later.

The reporting penalties get named early

The heaviest exposure on a cross-border file is usually a disclosure form, not the tax. We identify which ones apply before a deadline turns into a penalty.

We say early if it is not our work

If a file needs something this practice does not do, you hear that at the start rather than after a bill.

A fixed quote first, in writing

  • Step 1: Send what you already have – Slips, statements, prior returns — in any order. We list what is still needed after reading them.
  • Step 2: A fee agreed in writing – Quoted from those documents, before the work starts, and it does not move once you accept it.
  • Step 3: Each side drafted against the other – The returns are built together rather than in sequence, so relief is claimed once and in the right country.
  • Step 4: You approve before it is filed – The finished return comes to you first. Nothing is submitted on your behalf unseen.

Quoted up front, in writing.

What these engagements turn on

Case study 1

A US LLC Owned by a Canadian, Taxed Twice by Design

The two countries classify an LLC differently, so the credit relief that ought to apply frequently does not. The engagement looks at whether the structure can be changed, and where it cannot, at how to make the credit work.

Case study 2

Gains on Indian Shares Held From Abroad

Holding period and instrument decide the character of the gain, and the deduction at source applies before any of that is considered. The return is where the position is corrected.

Case study 3

A Non-Resident Estate Holding US Assets

US situs assets sit inside the US estate tax net regardless of where the owner lived, and the exemption available to a non-resident is not the resident one. The file establishes situs asset by asset before any relief is claimed.

Case study 4

Documentation Requested, and the Deadline Is Not Extendable

Contemporaneous documentation has to exist by the filing deadline, not be assembled when it is asked for, and the penalty protection turns on that timing. The engagement produces the analysis for the year in question and puts a repeatable process behind the next one.

Case study 5

A Foreign Subsidiary That Nobody Had Been Reporting

Owning a company abroad triggers an information return separate from the corporate return, with its own penalty. The work is the surplus and income computations behind it, which also determine how a future dividend is taxed on the way home.

A Taxable Presence Created Without an Office

Core International & Cross-Border Tax Services

International Tax Planning & Advisory

Strategy and compliance for income, assets and families spread across borders.

One coordinating team: filings on every side of the border are sequenced so treaty relief and foreign tax credits are claimed once — and in the right country.

U.S. & Cross-Border Tax Returns

Dual filers: U.S. citizens in Canada and Canadians with U.S. income run two parallel systems — we prepare both, in the right order, every year.

Expat & Emigration Tax

The move year is its own project: the elections and valuations filed that year decide the next decade of both countries’ returns.

Non-Resident Canadian Tax

Default withholding is 25% of gross: elective returns routinely turn over-withheld rent and pensions into refunds.

Transfer Pricing & BEPS

Documentation prepared with the return is the cheapest insurance in international tax; reconstructing it during an audit is the most expensive.

Cross-Border Estates & Trusts

Wills drafted for one country routinely misfire in the other — deemed disposition here, estate tax there, credits in between.

Cross-Border Corporate Tax

Expansion raises the same four questions every time — entity, PE, repatriation, payroll. We answer them before the tax authorities do.

India Tax for NRIs & Returning Residents

The deduction is taken on the sale price, not the gain — which is why an NRI property sale strands cash unless the certificate is applied for before closing.

Canadian Tax with a Foreign Element

Residency is decided on facts, not on a form — and the year you arrive or leave is the one where the largest amounts turn on the smallest details.

UAE Tax for Expats & Their Home Country

A zero-tax country is only half the answer — the question that decides the bill is whether the country you came from still treats you as resident.

Investment Funds & Holding Companies

Holding structures live or die on treaty access, beneficial ownership and substance — the MLI's principal-purpose test now sits over every arrangement.

A holding structure is only as good as its reporting. Foreign affiliates, accrued passive income and distributions each carry their own return, and the penalties on those attach to the form rather than to any tax being owed — so a structure that saves tax can still cost money if the information returns are late.

Investment funds cross-border tax — questions we are asked

What makes investment funds different from an ordinary filing?

A fund's tax profile is set by its vehicle, its investors' residence and the treaty entitlement of the entity that actually holds the assets — and anti-abuse tests now examine that entity's substance. An ordinary preparer applies the general rule and stops there, which is how the relief in the specific provision goes unclaimed.

Can you work with my existing accountant?

That is how most of these engagements run. They keep the domestic file, we take the cross-border piece, and the boundary is agreed in writing so nothing is done twice or missed.

How much foreign income is tax-free in Canada?

None of it is tax-free for being foreign. A Canadian resident is taxed on worldwide income, so foreign salary, interest, dividends, rent and gains all go on the return, converted to Canadian dollars. What genuinely reduces the bill is the basic personal amount, the credit for foreign tax already paid, and any treaty article that exempts a specific type of income. The reporting thresholds people have in mind — the foreign property statement, for one — govern reporting, not exemption. See the foreign tax credit.

What is a permanent establishment, and how easily do we create one?

A taxable presence in another country under the treaty — typically a fixed place of business such as an office, branch, factory or workshop, or a dependent agent habitually concluding contracts on your behalf. Some treaties add a services test measured in days. Purely preparatory or auxiliary activity is excluded, but that carve-out is narrower than it sounds: one senior employee working from home in the other country, with authority, has been enough. See business profits and permanent establishment.

What if I am behind on filings?

That is a routine engagement rather than an unusual one. We map the unfiled years and obligations first, then advise which catch-up route is open before anything is filed — the order matters more than the speed.

Do you publish your fee schedule?

Yes — the pricing pages carry the published fees and what moves them. The exact number for your scope is confirmed in writing after the first call.
