In short

A family's exposure is rarely one person's: a spouse's residence, a child's education plan and a parent's estate can each pull a different country into the same year.

On this page: the rule that applies here, the questions we are asked first, two finished files with their numbers, how an engagement runs, and the fee it starts from.

The rule that applies to this group and not the one next to it

A family's exposure is rarely one person's: a spouse's residence, a child's education plan and a parent's estate can each pull a different country into the same year.

Everything else on this page follows from this. An ordinary preparer will get the general position right and miss the specific one, because the specific one is not on the form. It has to be known about, claimed, and supported.

Individuals & families abroad cross border tax — priced before we start

For individuals and families abroad the fee is set by how many people in the household have to file and how many countries the year touches: one spouse with one return is a short engagement, while a second residence, children's education savings and an estate abroad is a different one. The price is agreed in writing first.

Three things we hear on the first call

  • My spouse and I are resident in different countries.
  • Our children's education savings may not be recognised where we live.
  • A parent's estate abroad will affect our filings for years.

If any of that sounds familiar, it is because it is the standard experience of anyone in this position. The rules were not written to be read together, and nobody is given a map. See also treaty-based structuring reviews.

The numbers, end to end

It is easier to see with numbers attached.

Credit relief on one stream of income

Take C$150,000 of income taxed in both countries. Assume the other country charged 28% on it and the home country would charge 44% on the same amount.

Credit relief on one stream of income
ItemAmount
Income taxed in both countriesC$150,000
Tax paid abroad (assumed 28%)C$42,000
Home tax on the same income (assumed 44%)C$66,000
Credit available (lesser of the two)C$42,000
Home tax still payableC$24,000

The credit absorbs C$42,000 and leaves C$24,000 payable at home, because the home rate on this income is the higher of the two. The balance is real cash and it is due on the home timetable, which is why instalments get raised in the first meeting. Your version of this table is the useful one, and it takes a short call and a document pack to produce.

An illustration, not a client file. The sums are chosen for legibility and the thresholds are stated for the example alone — nothing reaches a filing until it has been confirmed at source for your own year.

The numbers, end to end

Worked through with figures, the mechanism looks like this.

Credit relief on one stream of income

Take C$86,000 of income taxed in both countries. Assume the other country charged 20% on it and the home country would charge 39% on the same amount.

Credit relief on one stream of income
ItemAmount
Income taxed in both countriesC$86,000
Tax paid abroad (assumed 20%)C$17,200
Home tax on the same income (assumed 39%)C$33,540
Credit available (lesser of the two)C$17,200
Home tax still payableC$16,340

The credit absorbs C$17,200 and leaves C$16,340 payable at home, because the home rate on this income is the higher of the two. The balance is real cash and it is due on the home timetable, which is why instalments get raised in the first meeting. We run this on your actual numbers before advising anything, because the conclusion can invert with a modest change in inputs.

Example figures throughout, selected to make the rule visible, with rates and thresholds assumed for the demonstration. Your actual filing uses figures confirmed with the issuing authority for your tax year.

How the engagement runs, phase by phase

  1. Upload the file as it stands

A secure link arrives after the first call. Incomplete is fine; that is what the review is for.

  2. The number is settled up front

Priced from your own documents and confirmed in writing before any preparation begins.

  3. Both returns on one desk

One engagement covers every country the file touches, reconciled line against line.

  4. Your approval, then the filing

The return is yours to check first. We file once you say so.

Key terms behind this page, defined

Foreign affiliate
A non-resident corporation in which a Canadian resident holds a specified level of interest, bringing surplus computations and information reporting with it.
NRI
Non-resident Indian: an individual who is not resident in India under its day-count tests. NRIs are taxed by India only on Indian-source income, usually collected at source before any exemption.
TNMM
The transactional net margin method, testing an operating margin rather than a gross one — which is why it survives accounting differences that defeat gross-margin methods.
Streamlined filing
The US catch-up route for non-willful filers, requiring a limited number of back returns and account reports plus a signed certification. Availability ends when the IRS makes contact first.

Fixed fees around individuals & families abroad cross border tax

The other driver on a family file is history: how many years are outstanding in each country, and whether the statements, foreign account records and estate papers still exist or have to be requested. Bringing a settled position up to date costs less than reconstructing one.

Why clients bring individuals & families abroad cross border tax to us

Filed with the authority, not just prepared

The engagement runs to submission and to the correspondence that follows it, including the queries that arrive months later.

You deal with the person who did the work

The practitioner who prepared and reviewed your file is the one who answers the question about it.

Cross-border is the whole practice

International and cross-border tax is all we do — not a sideline next to domestic work. The edge cases on this page are our ordinary Tuesday.

One team, not two firms billing separately

You are not the go-between for two sets of advisers with two sets of assumptions. One engagement covers each country the file touches.

The engagement, start to finish

  • Step 1: Documents first, questions second – We read the file before asking anything, so the questions we do ask are the ones that matter.
  • Step 2: A quote you can hold us to – Fixed in writing against a defined scope. No hourly meter, and no revision after the fact.
  • Step 3: The order of filing decided deliberately – Which return goes first can decide whether relief is available at all. That is planned, not discovered.
  • Step 4: Nothing filed without your sign-off – You see the completed work, ask what you need to, and approve it before submission.

A Retirement Plan That Grows Tax-Deferred in Only One Country

Cross-border retirement accounts are recognised by treaty, but the deferral usually has to be elected rather than assumed. The engagement checks whether the election was made, makes it where it was missed, and reports the account on whichever side requires it.

An IRS Notice for a Year the Client Believed Was Settled

Core International & Cross-Border Tax Services

International Tax Planning & Advisory

Strategy and compliance for income, assets and families spread across borders.

One coordinating team: filings on every side of the border are sequenced so treaty relief and foreign tax credits are claimed once — and in the right country.

U.S. & Cross-Border Tax Returns

Dual filers: U.S. citizens in Canada and Canadians with U.S. income run two parallel systems — we prepare both, in the right order, every year.

Expat & Emigration Tax

The move year is its own project: the elections and valuations filed that year decide the next decade of both countries’ returns.

Non-Resident Canadian Tax

Default withholding is 25% of gross: elective returns routinely turn over-withheld rent and pensions into refunds.

Transfer Pricing & BEPS

Documentation prepared with the return is the cheapest insurance in international tax; reconstructing it during an audit is the most expensive.

Cross-Border Estates & Trusts

Wills drafted for one country routinely misfire in the other — deemed disposition here, estate tax there, credits in between.

Cross-Border Corporate Tax

Expansion raises the same four questions every time — entity, PE, repatriation, payroll. We answer them before the tax authorities do.

India Tax for NRIs & Returning Residents

The deduction is taken on the sale price, not the gain — which is why an NRI property sale strands cash unless the certificate is applied for before closing.

Canadian Tax with a Foreign Element

Residency is decided on facts, not on a form — and the year you arrive or leave is the one where the largest amounts turn on the smallest details.

UAE Tax for Expats & Their Home Country

A zero-tax country is only half the answer — the question that decides the bill is whether the country you came from still treats you as resident.

Cross-border tax for sellers shipping worldwide: marketplace withholding, foreign registrations and inventory nexus handled before they become audits.

Marketplaces withhold, remit and report in their own right, so the tax position of a single sale is decided by where the stock sat, where the buyer was and which platform collected — not by where the company is registered. We reconcile the platform's own filings against the returns before either is submitted.

Individuals & families abroad cross-border tax — questions we are asked

What makes individuals & families abroad different from an ordinary filing?

A family's exposure is rarely one person's: a spouse's residence, a child's education plan and a parent's estate can each pull a different country into the same year. An ordinary preparer applies the general rule and stops there, which is how the relief in the specific provision goes unclaimed.

Can you work with my existing accountant?

That is how most of these engagements run. They keep the domestic file, we take the cross-border piece, and the boundary is agreed in writing so nothing is done twice or missed.

Which country taxes my government pension or social security?

The treaty decides, and the answer differs by the type of retirement income. Many treaties give social security to the country of residence, sometimes exclusively, while a pension for government service can stay taxable only in the paying country. Some treaties also cap the taxable proportion or preserve an exemption the source country gives its own residents. Because the categories are distinct, one household can have two pensions taxed by two different countries. See the pensions and annuities article.

What is a double tax treaty and what does it actually do?

It is an agreement between two countries that divides up the right to tax. Article by article it decides which country taxes employment income, dividends, interest, royalties, pensions, property and business profits — and where both may tax, it caps what the source country can withhold and tells the other to give credit. It also breaks residence ties and opens a government-to-government channel for disputes. What it never does is apply itself: a treaty position is claimed. See our treaty work.

Who reviews the work?

A named reviewer signs off every statutory filing, and their name and the review date appear on the advice you receive.

How do you decide what is out of scope?

It is written down before we start. Anything not named in the scope is quoted separately rather than assumed, which is what stops the fee moving.
