The mechanism, in plain terms

Selling the property is the easy part. Getting the money out requires a tax certification and an exchange-control route, and banks will not move funds until both are satisfied.

A remitter declaration and, for chargeable sums, an accountant's certificate precede the transfer, and the account the funds sit in determines the annual limit and documentation. Sale proceeds of inherited property follow a different route again.

That mechanism has a practical edge to it: it rewards preparation and punishes discovery. A filer who maps the obligation before the year ends is choosing between options; a filer who finds it afterwards is usually choosing between remedies.

Because a wrong number is worse than no number, every rate and threshold in your file is confirmed for your year at source. An NRI sells Indian property for ₹8,900,000 with an indexed cost of ₹5,073,000. Assume the buyer must deduct at 14% of the consideration, and assume tax on the gain at 16%.

₹633,680 more is deducted than the transaction actually owes. A lower-deduction certificate obtained before closing is what releases it at the table; without one it sits with the department until a return recovers it. The interesting question is where your own figures fall relative to that, which is a computation rather than an opinion.

Repatriating sale proceeds out of India — can I handle this myself?

Some of it, yes — and we will say so on the call if that is the honest answer. The parts that are worth paying for are the ones where a missed election, a missed deadline or an unverified threshold costs more than the fee: a remitter declaration and, for chargeable sums, an accountant's certificate precede the transfer, and the account the funds sit in determines the annual limit and documentation.

What if I have already filed and got it wrong?

That is a common starting point. We re-derive the position, identify whether an amendment or a disclosure route is the right vehicle, and tell you which one preserves the relief that is still available. The order matters more than the speed.

How long will it take?

It depends on the documents rather than on us. Once the pack is complete most filings turn around inside a fortnight; anything that needs a certificate from a tax authority runs on that authority's timetable, which we tell you at the start rather than at the end.

What is a permanent establishment, and how easily do we create one?

A taxable presence in another country under the treaty — typically a fixed place of business such as an office, branch, factory or workshop, or a dependent agent habitually concluding contracts on your behalf. Some treaties add a services test measured in days. Purely preparatory or auxiliary activity is excluded, but that carve-out is narrower than it sounds: one senior employee working from home in the other country, with authority, has been enough. How does an NRI prove residence to get the treaty rate?

With a tax residency certificate issued by the country you are resident in, plus Form 10F giving the details the certificate does not carry, plus a PAN in the payer's records. The certificate has to cover the period of the payment, and the payer needs it before paying, not afterwards. Missing any of the three and the deductor is obliged to withhold at the domestic rate, which turns a rate reduction into a refund claim. See TRC against Form 10F.

Which business structure has double taxation?

The corporation — specifically a US C corporation, where profit is taxed to the company and the dividend again to the shareholder. Sole proprietorships, partnerships and LLCs treated as flow-throughs are taxed once, in the owners' hands. Across borders that tidy answer breaks: an entity treated as a flow-through in one country can be opaque in the other, which produces a mismatch neither system planned for. Filing correctly does not create risk; a pattern of missing filings does. Where a disclosure route is involved we set out what the authority will see and in what order before you commit to it.
