Why the order matters more in cross-border work

Because a cross-border return contains judgement calls you are entitled to see before they are submitted in your name: which country is treated as taxing first, which treaty article is being relied on, how a foreign figure was converted, which of two available elections was made. On a file that is prepared, filed and invoiced in one motion, you find out about those decisions after they have been made. Here the review step exists so you find out before.

What do you need before you start?

The fee agreed in writing, the documents, and the signed authorisations that let us act with the tax authority on your behalf. Nothing is prepared until all three are in place.

What does "approve" actually mean — am I signing off on the tax positions?

You are confirming that the facts are right and that you have seen the work. The technical positions are ours, they are explained to you in plain terms before you approve, and the review exists precisely so you can ask why something was done that way while it can still be changed.

What if I do not approve the work?

Then it is not filed, and we deal with whatever the objection is. In practice the review step catches factual corrections — a missing slip, a figure from the wrong account — and those are fixed and re-sent. Approval is the checkpoint, and the engagement is not finished until the result is right.

How does a remittance actually work, and is it taxed?

A remittance is a transfer of money, not a category of income, and moving your own funds between your own accounts is not what creates tax. What can create tax is the income behind the money and the rules of the country it leaves. India, for instance, collects tax at source when a resident individual remits abroad under the Liberalised Remittance Scheme, and requires certification before certain payments leave. The transfer is the trigger for paperwork rather than for tax. See the LRS and tax collected at source.

I have not filed for several years while living abroad — what are my options?

Both countries have routes back, and using one before they contact you is what preserves the relief. On the US side there are procedures aimed at taxpayers whose failure was not wilful, including one designed for people living outside the country, and separate procedures for late account reports and information returns alone. Canada has its voluntary disclosures programme and taxpayer relief for penalties and interest. Filing quietly and hoping is the one approach with no protection attached to it. See catch-up filing.

Is double taxation legal?

Yes. Nothing prevents two countries from taxing the same income under their own domestic law — each is exercising its own jurisdiction. What treaties and credit systems do is relieve the outcome rather than prohibit the charge, and relief is generally something you must claim on a return or a form, not something applied automatically.
