Key terms behind this page, defined

Deemed disposition
A rule that treats property as sold at market value even though nothing was sold — on emigration, on death, or on a change of use. Tax arises without a cash event.
Unilateral relief
Relief for foreign tax given by domestic law where no treaty applies. It is usually narrower than treaty relief and is the fallback in a non-treaty corridor.
Place of effective management
The place where key management and commercial decisions are in substance made, which can make a foreign-incorporated company resident in another country.
Taxable Canadian property
The class of property whose disposition by a non-resident is taxable in Canada, including Canadian real property and certain shares.

What is an advance pricing arrangement?

An agreement with a tax authority, in advance, on how a category of intercompany transactions will be priced for a set number of years. Unilateral arrangements bind one country; bilateral or multilateral ones bind both sides of the transaction and are what actually removes the risk of an adjustment in one country without relief in the other. What is OECD Pillar One?

The part of the international agreement that reallocates a share of taxing rights over the very largest and most profitable groups to the jurisdictions where their customers and users are, regardless of physical presence — plus a simplified approach to routine marketing and distribution returns. It is aimed at the digitalised economy problem that physical-presence rules could not reach, and its implementation is still moving, which is why we read the current instrument rather than the original blueprint. Do I need transfer pricing documentation?

If your company transacts with a related party in another country, in substance yes — the question is how much. Documentation is what shifts the burden: prepared before the filing deadline it evidences that your pricing was set on arm's length terms, and its absence is what turns a pricing adjustment into a penalty in several regimes.
