Seychelles in 60 words

Historic offshore companies are foreign corporations for home reporting purposes whether or not they are active, and unwinding them is itself a reportable event. Most of the expats who ask us about Seychelles still have a filing footprint at home, and residence — not the address on the envelope — decides whether it stays open.

Who we act for here

Legacy offshore structures and clients unwinding them.

Regional filing pattern

Two patterns dominate here: rotation in resources and employment in the development sector. The first is a day-count question; the second often turns on the employer's status.

The question that decides it

Historic offshore companies are foreign corporations for home reporting purposes whether or not they are active, and unwinding them is itself a reportable event.

Do you still file at home?

It depends entirely on which system claims you. Canadian residence is a facts test — home, family, economic connections — and it ends when those end. US citizenship is not a facts test at all: the filing obligation continues in Seychelles exactly as it would at home. Indian residence is arithmetic, applied to days, with a transitional status that matters enormously to anyone moving back.

Historic offshore companies are foreign corporations for home reporting purposes whether or not they are active, and unwinding them is itself a reportable event.

Two of the firm’s advisers and the team in the open-plan office

Fixed fees for seychelles tax for expats, agreed up front

Seychelles work is priced by the number of structures and how long they have gone unreported. A dormant offshore company is still a foreign corporation for home reporting, so one quiet entity with several unfiled years is often more work than an active one that has always been declared.

Residency and the tie-breaker

When Seychelles and your home country both say you are resident, the treaty — where one is in force — produces a single answer rather than a split. It applies its tests in a fixed order, and the practical consequence is that a lease, a school registration or a set of medical records can be worth more to the file than any amount of subsequent explanation.

We confirm the treaty in force for your year, including any protocol and any modification made through the multilateral instrument, before relying on an article. Treaty networks change, and a summary written three years ago is not evidence about this year.

Income by type: who taxes what

How each income type is treated in this corridor
Income typeGeneral treatment
Pensions and retirement incomeDecided by the specific pension article, which is the least uniform provision in the treaty network.
Capital gain on property thereGenerally taxable where the property is situated, with the home country taxing the same gain and giving credit.
Income from a locally registered company you controlMay be attributed to you before distribution under your home country's controlled-company rules, whatever the local treatment.
Local partnership or LLP shareTaxable where the business is carried on, but whether your home country sees the entity as transparent decides in which year it taxes you.
Gains on shares deriving value from local propertyCommonly treated like the underlying property rather than like ordinary shares, which reverses the usual answer on share gains.
Social security and state pensionsTreated differently from private pensions in most treaties, and sometimes reserved entirely to one state.
Insurance and annuity payoutsOften outside both the pension article and the other-income article, which is precisely why the treatment has to be checked rather than assumed.

The local nuance

Historic offshore companies are foreign corporations for home reporting purposes whether or not they are active, and unwinding them is itself a reportable event. None of that is exotic, but it is corridor-specific — and corridor-specific detail is what a template answer cannot supply.

Worked through with figures

Put numbers against it and the shape of the answer is obvious.

Credit relief on one stream of income

Take C$113,000 of income taxed in both countries. Assume the other country charged 25% on it and the home country would charge 30% on the same amount.

Credit relief on one stream of income
ItemAmount
Income taxed in both countriesC$113,000
Tax paid abroad (assumed 25%)C$28,250
Home tax on the same income (assumed 30%)C$33,900
Credit available (lesser of the two)C$28,250
Home tax still payableC$5,650

The credit absorbs C$28,250 and leaves C$5,650 payable at home, because the home rate on this income is the higher of the two. The balance is real cash and it is due on the home timetable, which is why instalments get raised in the first meeting. The shape of that result holds; the size of it depends entirely on your own numbers and dates.

Illustrative figures, not a client engagement: the amounts are chosen to make the mechanism legible, and the rates and thresholds are assumptions stated for the example only. We confirm every one of them against the issuing authority for your own tax year before anything is filed.

Three mistakes we see most

  1. Waiting for the foreign assessment before paying anything at home, and collecting interest on a liability that later disappears.
  2. Treating a bank's tax-residence questionnaire as the answer rather than as a question, and certifying a status that the filings then contradict.
  3. Not writing down the departure or arrival date at the time, so every later computation rests on a date nobody can evidence.
  • Nothing is filed until you have read it.
  • Authorisation with each authority, so we see the assessments and slips directly rather than asking you for them.
  • Every statutory figure in your file is verified for your own year at source.

The first call establishes whether there is work to do. Everything after that is quoted.

How the engagement runs, phase by phase

  1. Send the documents as they are

No tidying required — forward what you have and we tell you what is missing.

  2. Get a fixed quote in writing

Priced from your actual documents before any work begins, not estimated after.

  3. Both countries prepared together

One team builds the filings against each other so the relief lands exactly once.

  4. Review, then file

Key terms behind this page, defined

Profit level indicator
The ratio used to measure the tested party's profitability — an operating margin, a return on costs or a return on assets, chosen to fit its functions.
Split-year treatment
The mechanism by which a year of arrival or departure is divided into resident and non-resident periods for reporting, even though the year itself remains one tax year.
Unified credit
The mechanism by which a US estate and gift tax exemption is applied. The amount available to a non-resident is far smaller than to a US person unless a treaty adjusts it.
CFC
Controlled foreign corporation — the US concept whose earnings in defined categories are taxed to US shareholders before distribution.

Unwinding changes the shape of the engagement again. Striking off or distributing out of a legacy Seychelles company is itself a reportable event, and share registers, historic accounts and the original funding usually have to be reconstructed before anything can be filed. Reconstruction, not filing, is where the hours go.

Deduction at Source on Deposit Interest, Recovered

Where the treaty rate is lower than what was deducted, the difference comes back through a return rather than at source. The file establishes entitlement and files for the years still open.

The Same Income Taxed Twice on Paper

Relief usually exists and is lost to sequence: one country taxes at source and the other credits it, and preparing them in the wrong order claims a credit against a figure nobody has computed.

A Student or Researcher Covered by a Treaty Article

Coming Back to Canada After Years Abroad

Returning restarts Canadian residence and re-values what you own on the day you arrive. Foreign pensions, employer plans and accounts opened abroad each land differently, and the reporting thresholds are tested against the whole portfolio rather than each account.

Core International & Cross-Border Tax Services

International Tax Planning & Advisory

Strategy and compliance for income, assets and families spread across borders.

One coordinating team: filings on every side of the border are sequenced so treaty relief and foreign tax credits are claimed once — and in the right country.

U.S. & Cross-Border Tax Returns

Dual filers: U.S. citizens in Canada and Canadians with U.S. income run two parallel systems — we prepare both, in the right order, every year.

Expat & Emigration Tax

The move year is its own project: the elections and valuations filed that year decide the next decade of both countries’ returns.

Non-Resident Canadian Tax

Default withholding is 25% of gross: elective returns routinely turn over-withheld rent and pensions into refunds.

Transfer Pricing & BEPS

Documentation prepared with the return is the cheapest insurance in international tax; reconstructing it during an audit is the most expensive.

Cross-Border Estates & Trusts

Wills drafted for one country routinely misfire in the other — deemed disposition here, estate tax there, credits in between.

Cross-Border Corporate Tax

Expansion raises the same four questions every time — entity, PE, repatriation, payroll. We answer them before the tax authorities do.

India Tax for NRIs & Returning Residents

The deduction is taken on the sale price, not the gain — which is why an NRI property sale strands cash unless the certificate is applied for before closing.

Canadian Tax with a Foreign Element

Residency is decided on facts, not on a form — and the year you arrive or leave is the one where the largest amounts turn on the smallest details.

UAE Tax for Expats & Their Home Country

A zero-tax country is only half the answer — the question that decides the bill is whether the country you came from still treats you as resident.

Seychelles — questions we are asked

Do I have to file at home while living in Seychelles?

It depends on residence, not on address — except for US citizens and green-card holders, for whom the answer is yes regardless of where they live. We settle the residence question first, because every other answer follows from it.

Is there a treaty between my country and Seychelles?

Possibly, and the version in force for your year is the one that matters — protocols and multilateral-instrument positions change what a treaty does without changing its name. We check it against the authority rather than a summary. Where no treaty applies, domestic relief takes over.

I own property in Seychelles. Where is the rent taxed?

In Seychelles, because that is where the property sits. The complication is the base: gross-rent withholding takes no account of mortgage interest, tax or repairs, so a leveraged property can face tax on turnover. An election onto net profit, where it exists, is what fixes that — and it has its own timing.

What does "RIC" mean on my foreign tax paid statement?

Registered Investment Company — a US mutual fund or ETF. When a fund holds securities from many countries it may report the foreign tax it paid on your behalf without breaking it down by country, using RIC as the country label. You are allowed to use it that way on Form 1116 for that income, which saves you reconstructing a country-by-country split you have no way of knowing. See Form 1116.

Is my Indian provident fund or PPF still tax-free now that I live abroad?

The exemption is an Indian one, and it does not travel. Your new country of residence taxes worldwide income under its own rules, and several — the United States in particular — may treat the annual growth in a foreign retirement or savings plan as currently taxable and separately reportable, whether or not you withdrew anything. So an account that is genuinely tax-free in India can be a taxable, reportable asset where you now live. See Indian pensions received abroad.

How much foreign income is tax-free in the United States?

Nothing is exempt in the USA merely for arising abroad — a US person is taxed on worldwide income. What exists is an election: the foreign earned income exclusion removes foreign *earned* income up to an annual cap if you meet one of two qualifying tests, $132,900 for 2026 and $130,000 for 2025, with a separate housing amount alongside it. It does not touch investment income, pensions or gains, and it is claimed on a form rather than assumed. See the foreign earned income exclusion.
