Superficial loss
A denied loss where the same or identical property is reacquired within a defined period around the sale by the taxpayer or an affiliated person.
Double taxation
The same income taxed twice. Relief comes from a treaty article giving one country the exclusive right, from a credit, or from an exemption — claimed, never automatic.
Ordinarily resident
A status used in some systems for someone habitually resident in the country, which can limit or extend the income within the charge independently of the residence test.
Tax treaty
A bilateral agreement allocating taxing rights between two countries, capping withholding rates, resolving dual residence and providing for relief from double taxation.

Indian TP documentation & Form 3CEB — do I need an adviser, or can I do it alone?

Some of it, yes — and we will say so on the call if that is the honest answer. The parts that are worth paying for are the ones where a missed election, a missed deadline or an unverified threshold costs more than the fee: the report certifies the transactions, the method and the pricing, and it is accompanied by the prescribed documentation.

What if I have already filed and got it wrong?

That is a common starting point. We re-derive the position, identify whether an amendment or a disclosure route is the right vehicle, and tell you which one preserves the relief that is still available. The order matters more than the speed.

How long will it take?

It depends on the documents rather than on us. Once the pack is complete most filings turn around inside a fortnight; anything that needs a certificate from a tax authority runs on that authority's timetable, which we tell you at the start rather than at the end.

Is "fund transfer pricing" the same thing as transfer pricing?

No — and if you came here to calculate FTP, this is not it. Fund transfer pricing is a bank's internal allocation of funding costs and benefits between its own business units, a treasury and asset-liability management discipline used to measure branch or product profitability. Tax transfer pricing is about prices between legally separate related parties across borders, and about which country taxes the resulting profit. The words overlap; the fields do not. Is money received in India from abroad taxable?

Receiving your own money is not income, and a gift from a specified relative is exempt however large. Two things do bite. A gift from someone outside that relative list is taxable to the recipient once the year's receipts pass the threshold in the gift provisions. And money that is really payment for something — fees, rent, interest, a share of profit — is taxed as that income whatever the bank narration says. The paperwork should match the substance. What is the difference between a master file and a local file?

The master file describes the group as a whole — its structure, where value is created, how intangibles and financing are held. The local file covers one entity's own related-party transactions in detail, with the analysis supporting each price. Larger groups file both, plus country-by-country reporting above a size threshold, and the thresholds differ by country. See master file vs local file.

Do you keep my documents?

For the retention period the professional rules require, in the same access-controlled system, and no longer than that.

What happens if the rules change mid-engagement?
