In short

Software and subscription revenue is characterised differently across jurisdictions — as services, as royalties, or as a digital supply — and the characterisation changes both withholding and indirect tax.

On this page: the rule that applies here, the questions we are asked first, two finished files with their numbers, how an engagement runs, and the fee it starts from.

The rule that applies to this group and not the one next to it

Software and subscription revenue is characterised differently across jurisdictions — as services, as royalties, or as a digital supply — and the characterisation changes both withholding and indirect tax.

One question decides the rest of the file. Two people with identical incomes and identical passports can owe completely different amounts because one of them falls inside a provision the other does not. That is the whole reason this page exists as its own page rather than as a paragraph on a general one.

Transparent, fixed pricing for technology & saas relief you're probably missing

Recovering relief a technology and SaaS group has missed is priced on how far back it reaches and how many jurisdictions withheld on your invoices. One country and one open year is a contained review; several years of withheld receipts across several treaty partners is a different engagement. Both are quoted in writing first.

Three things we hear on the first call

  • Some customers withhold tax on our invoices and others do not.
  • We have engineers in three countries and one corporate entity.
  • Our contracts were written domestically and we now sell globally.

We hear versions of all three most weeks. The confusion is structural rather than personal: nothing in either system is designed to explain the other. See also Canadian with foreign inheritance.

Worked through with figures

Numbers make this concrete, so here is the same rule applied to a set of figures.

Equity that vests after the move

A grant worth C$138,000 at vest, over a 40-month vesting period, 8 months of which were worked in the first country and 32 in the second.

Equity that vests after the move
ItemAmount
Value at vestC$138,000
Vesting period (months)40
Months worked in the first country8
Months worked in the second country32
Apportioned to the first countryC$27,600
Apportioned to the second countryC$110,400

Two countries tax slices of one gain: C$27,600 and C$110,400 on this apportionment. Where their taxing points differ — grant, vest, exercise or sale — the credit can arrive in a year the other country is no longer taxing, which is the mismatch to plan around. Your version of this table is the useful one, and it takes a short call and a document pack to produce.

The figures here are an illustration, not an engagement: amounts are picked so the mechanism is easy to follow, and every rate or threshold is an assumption of the example. Before anything is filed for you, each one is confirmed with the issuing authority for your own tax year.

The numbers, end to end

This is what the rule produces when you put figures through it.

Credit relief on one stream of income

Take C$129,000 of income taxed in both countries. Assume the other country charged 23% on it and the home country would charge 28% on the same amount.

Credit relief on one stream of income
ItemAmount
Income taxed in both countriesC$129,000
Tax paid abroad (assumed 23%)C$29,670
Home tax on the same income (assumed 28%)C$36,120
Credit available (lesser of the two)C$29,670
Home tax still payableC$6,450

The credit absorbs C$29,670 and leaves C$6,450 payable at home, because the home rate on this income is the higher of the two. The balance is real cash and it is due on the home timetable, which is why instalments get raised in the first meeting. That is an illustration of the mechanism, not a prediction about your file — the same computation on your figures is the first thing we do.

An illustration, not a client file. The sums are chosen for legibility and the thresholds are stated for the example alone — nothing reaches a filing until it has been confirmed at source for your own year.

What working with us looks like

  1. 1A call to the 24-hour helpline to find out whether this is a filing or a project
  2. 2A fixed fee for a written scope — re-quoted if the scope changes, never invoiced silently
  3. 3Preparation against the evidence, with the positions documented as we go
  4. 4Your approval, then the filing — in that order
  • Rated 5.0 out of 5 stars on Google, on a profile open for you to read.
  • A 24-hour helpline, +1 (416) 619-0068, before you commit to anything.
  • Consultations scheduled to your working day rather than ours.

Where to go from here

We would rather scope it properly than quote it quickly.

International tax accountant — what this page covers

The search that brings most people to this page is international tax accountant. It is answered here for technology & SaaS: relief you're probably missing: what creates the obligation, which filings discharge it, and the fee agreed before the work starts.

How the engagement runs, phase by phase

  1. Upload the file as it stands

A secure link arrives after the first call. Incomplete is fine; that is what the review is for.

  2. The number is settled up front

Priced from your own documents and confirmed in writing before any preparation begins.

  3. Both returns on one desk

One engagement covers every country the file touches, reconciled line against line.

  4. Your approval, then the filing

The return is yours to check first. We file once you say so.

Key terms behind this page, defined

Substantial presence test
The US day-count test for residence. It weights the current year most heavily and includes fractions of the two preceding years, so a pattern of visits can create residence without any single long stay.
Mark-to-market election
An election to tax a holding on its annual change in value rather than on realisation, available for certain foreign funds and used to escape the default regime.
Clearance certificate
Confirmation that all amounts owing by a deceased person and their estate have been paid. Distributing without one exposes the representative personally.
OIDAR
India's regime for online information and database access services, taxing a foreign supplier on sales to Indian consumers.

Technology & saas relief you're probably missing — what the published fees look like

The fees in this second band cover the claims themselves. What decides them is whether the relief can still be claimed on an open return, or whether earlier years must be reopened and a residency certificate obtained from the authority before anything can be lodged for your SaaS business.

Why choose Legal Quotient for technology & saas relief you're probably missing

The fee is fixed before we start

Quoted from your documents and agreed in writing. The number you accept is the number you pay.

The order of filing is planned, not improvised

Which return goes first decides whether relief can be claimed at all. That sequence is worked out before anything is submitted.

Cross-border is the whole practice

International and cross-border tax is all we do — not a sideline next to domestic work. The edge cases on this page are our ordinary Tuesday.

Filed with the authority, not just prepared

The engagement runs to submission and to the correspondence that follows it, including the queries that arrive months later.

From first document to filed return

  • Step 1: Documents first, questions second – We read the file before asking anything, so the questions we do ask are the ones that matter.
  • Step 2: A quote you can hold us to – Fixed in writing against a defined scope. No hourly meter, and no revision after the fact.
  • Step 3: The order of filing decided deliberately – Which return goes first can decide whether relief is available at all. That is planned, not discovered.
  • Step 4: Nothing filed without your sign-off – You see the completed work, ask what you need to, and approve it before submission.

Quoted up front, in writing.

Cross-border tax case studies

Case study 1

The Same Income Taxed Twice on Paper

Relief usually exists and is lost to sequence: one country taxes at source and the other credits it, and preparing them in the wrong order claims a credit against a figure nobody has computed.

Read how this one runs
Case study 2

One Salary, Two Countries Claiming It

A US citizen resident in Canada, taxed in full on both sides because each return was prepared without the other in view. Deciding which country has the first right to the income, then claiming relief on the second return in the right order, is what stops the same dollar being taxed twice.

Case study 3

A US Filer Married to Someone Outside the System

Electing to treat a non-resident spouse as a US filer buys joint rates and brings that spouse's worldwide income and foreign accounts into the return. The election is easy to make and hard to revoke, so both positions are modelled first.

Case study 4

A Retirement Plan That Grows Tax-Deferred in Only One Country

Cross-border retirement accounts are recognised by treaty, but the deferral usually has to be elected rather than assumed. The engagement checks whether the election was made, makes it where it was missed, and reports the account on whichever side requires it.

Case study 5

US Estate Tax on Assets a Canadian Did Not Know Were Exposed

US shares and US real estate sit inside the US estate tax net regardless of where the owner lives. The treaty provides relief that is proportionate rather than automatic, and the calculation depends on the worldwide estate.

Case study 6

A TFSA That Costs More Than It Saves

Canadian tax-free accounts are not tax-free to a US person, and some of them carry a reporting form of their own. The file is a review of what is held, what each account triggers on the US side, and whether the account is worth keeping once the reporting is priced in.

Case study 7

Two Passports, Two Returns, One Income

Dual citizenship does not let you choose which country taxes you. The work is establishing residence, applying the treaty article that governs each income type, and preparing both returns from one set of figures so they agree line for line.

Paid for Work Done in Canada While Living Elsewhere

Employment carried out in Canada is taxable here even where the employer and the bank account are not. The engagement establishes how many of the days were worked in Canada, applies the treaty employment article, and deals with the withholding the payer has already taken.

Core International & Cross-Border Tax Services

International Tax Planning & Advisory

Strategy and compliance for income, assets and families spread across borders.

One coordinating team: filings on every side of the border are sequenced so treaty relief and foreign tax credits are claimed once — and in the right country.

U.S. & Cross-Border Tax Returns

Dual filers: U.S. citizens in Canada and Canadians with U.S. income run two parallel systems — we prepare both, in the right order, every year.

Expat & Emigration Tax

The move year is its own project: the elections and valuations filed that year decide the next decade of both countries’ returns.

Non-Resident Canadian Tax

Default withholding is 25% of gross: elective returns routinely turn over-withheld rent and pensions into refunds.

Transfer Pricing & BEPS

Documentation prepared with the return is the cheapest insurance in international tax; reconstructing it during an audit is the most expensive.

Cross-Border Estates & Trusts

Wills drafted for one country routinely misfire in the other — deemed disposition here, estate tax there, credits in between.

Cross-Border Corporate Tax

Expansion raises the same four questions every time — entity, PE, repatriation, payroll. We answer them before the tax authorities do.

India Tax for NRIs & Returning Residents

The deduction is taken on the sale price, not the gain — which is why an NRI property sale strands cash unless the certificate is applied for before closing.

Canadian Tax with a Foreign Element

Residency is decided on facts, not on a form — and the year you arrive or leave is the one where the largest amounts turn on the smallest details.

UAE Tax for Expats & Their Home Country

A zero-tax country is only half the answer — the question that decides the bill is whether the country you came from still treats you as resident.

Global E-commerce & Marketplaces

Cross-border tax for sellers shipping worldwide: marketplace withholding, foreign registrations and inventory nexus handled before they become audits.

Marketplaces withhold, remit and report in their own right, so the tax position of a single sale is decided by where the stock sat, where the buyer was and which platform collected — not by where the company is registered. We reconcile the platform's own filings against the returns before either is submitted.

Technology & SaaS — relief you're probably missing — questions we are asked

What makes technology & saas different from an ordinary filing?

Software and subscription revenue is characterised differently across jurisdictions — as services, as royalties, or as a digital supply — and the characterisation changes both withholding and indirect tax. An ordinary preparer applies the general rule and stops there, which is how the relief in the specific provision goes unclaimed.

Can you work with my existing accountant?

That is how most of these engagements run. They keep the domestic file, we take the cross-border piece, and the boundary is agreed in writing so nothing is done twice or missed.

Do American citizens living abroad have to pay taxes?

American expats and green card holders need to file US returns for life, and many of them pay little or no US tax once the relief is applied — but the filing is what unlocks the relief, so the two questions have different answers. The exclusion for foreign earned income, the credit for foreign tax already paid and the treaty between the two countries between them usually leave the total at roughly the higher of the two countries' tax rather than the sum. Skip the return and none of it applies. See Americans abroad.

Is double taxation illegal?

It is legal. Two countries can each have a valid claim on the same income — one because the income arose there, the other because you live there — and nothing prohibits both from exercising it. What exists instead is relief: tax treaties allocate the claim, and domestic law gives a credit for foreign tax paid. The relief is not automatic, though. It is claimed on a return, and unclaimed relief is simply lost. See how double taxation is relieved.

Can you deal with the tax authority for me?

Yes, once the authorisation is filed. That also lets us see the assessments, slips and instalment records directly, which is usually where the discrepancies turn up.

What if an authority disagrees later?

The file is built to be defended: the position, the authority relied on, and the evidence, all recorded at the time. Representation in a review or objection is quoted separately when it is needed.
