LRS limits & TCS on remittances is an information return: How the remittance scheme's annual limit and the tax collected at source on outward remittances work together. Resident individuals remitting funds abroad and families funding education or property purchases overseas.

Does this bind you?

Resident individuals remitting funds abroad and families funding education or property purchases overseas.

Everything else on this page follows from this. Tax collected at source is not a cost — it is a prepayment creditable against the year's Indian tax — but it is real cash out of the transfer, and the rate depends on the declared purpose. Sequencing the year's remittances is the planning.

LRS limits & TCS on remittances India — priced before we start

Pricing on LRS remittances depends on how many transfers the year holds and what they are for, because the tax collected at source turns on the declared purpose — education, property and investment each behave differently. Recovering what was collected as a credit in the Indian return is separate work. Both are quoted in writing.

Jurisdiction and authorityIndia — Income Tax Department
Category of filingInformation return

When it is due

Information returns are generally due with — or on the same timetable as — the return they accompany, so the deadline is the filing deadline of the underlying return unless the rules set a separate date. Where an extension covers the return, confirm whether it also covers this form; several information returns keep their own date. The deadline is set out in writing with the engagement, along with what has to be in our hands to meet it.

What late or missed filing costs

The penalty on an information return is charged per form and per year, and it does not depend on tax being owed. That is the whole risk profile: a filer with no tax to pay can still accumulate a substantial liability across unfiled years, and the exposure compounds with each additional entity or account that should have been reported. We quantify the exposure in writing before recommending a route, so the decision is made on numbers rather than on anxiety.

The numbers, end to end

Worked through with figures, the mechanism looks like this.

Deduction on the price against tax on the gain

An NRI sells Indian property for ₹15,900,000 with an indexed cost of ₹11,130,000. Assume the buyer must deduct at 20% of the consideration, and assume tax on the gain at 15%.

Deduction on the price against tax on the gain
ItemAmount
Sale consideration₹15,900,000
Cost taken into account₹11,130,000
Gain actually arising₹4,770,000
Deduction on the consideration (assumed 20%)₹3,180,000
Tax on the gain (assumed 15%)₹715,500
Cash held back beyond the real tax₹2,464,500

₹2,464,500 more is deducted than the transaction actually owes. A lower-deduction certificate obtained before closing is what releases it at the table; without one it sits with the department until a return recovers it. That is an illustration of the mechanism, not a prediction about your file — the same computation on your figures is the first thing we do.

Illustrative figures, not a client engagement: the amounts are chosen to make the mechanism legible, and the rates and thresholds are assumptions stated for the example only. We confirm every one of them against the issuing authority for your own tax year before anything is filed.

How we prepare and file it, and what it costs

Pricing is settled first: a written scope and a fixed fee for it, before any work begins. See the advance pricing agreements in India for comparable engagements.

What working with us looks like

  1. 1Establish whether the reporting test is met, on the correct measure
  2. 2Assemble the holdings, accounts or entities that fall inside it
  3. 3Prepare the return and reconcile it to the tax return it travels with
  4. 4File, and set the calendar entry so next year is not a catch-up
  • Consultations scheduled to your working day rather than ours.
  • Nothing is filed until you have read it.
  • Authorisation with each authority, so we see the assessments and slips directly rather than asking you for them.

Ask before the move rather than after it, because most of the useful options expire on the date.

LRS limits & TCS on remittances India: How we read this one

Tax collected at source is not a cost — it is a prepayment creditable against the year's Indian tax — but it is real cash out of the transfer, and the rate depends on the declared purpose.

Whatever the file turns out to involve, the terms do not move: the scope and the fee are agreed in writing before any work starts, a named practitioner reviews the result, and nothing is filed until you have approved it.

The smaller fees below are for the planning rather than the paperwork: sequencing a family's remittances across the year, checking a bank's certificate before funds leave, or reconciling the tax collected at source against the credit claimed. Why clients bring LRS limits & TCS on remittances India to us

One team, not two firms billing separately

You are not the go-between for two sets of advisers with two sets of assumptions. One engagement covers each country the file touches.

We say early if it is not our work

If a file needs something this practice does not do, you hear that at the start rather than after a bill.

Late and missed years are ordinary work

An unfiled history is not a reason to wait longer. We assess what is still open and what relief the delay attracts before the first return goes in.

  • Step 3: One position across every return – The same facts, filed consistently on each side, so nothing contradicts anything else.
  • Step 4: Filed after you have read it – The completed work reaches you before it reaches an authority.

Core International & Cross-Border Tax Services

International Tax Planning & Advisory

Strategy and compliance for income, assets and families spread across borders.

One coordinating team: filings on every side of the border are sequenced so treaty relief and foreign tax credits are claimed once — and in the right country.

U.S. & Cross-Border Tax Returns

Dual filers: U.S. citizens in Canada and Canadians with U.S. income run two parallel systems — we prepare both, in the right order, every year.

Expat & Emigration Tax

The move year is its own project: the elections and valuations filed that year decide the next decade of both countries’ returns.

Non-Resident Canadian Tax

Default withholding is 25% of gross: elective returns routinely turn over-withheld rent and pensions into refunds.

Transfer Pricing & BEPS

Documentation prepared with the return is the cheapest insurance in international tax; reconstructing it during an audit is the most expensive.

Cross-Border Estates & Trusts

Wills drafted for one country routinely misfire in the other — deemed disposition here, estate tax there, credits in between.

Cross-Border Corporate Tax

Expansion raises the same four questions every time — entity, PE, repatriation, payroll. We answer them before the tax authorities do.

India Tax for NRIs & Returning Residents

The deduction is taken on the sale price, not the gain — which is why an NRI property sale strands cash unless the certificate is applied for before closing.

Canadian Tax with a Foreign Element

Residency is decided on facts, not on a form — and the year you arrive or leave is the one where the largest amounts turn on the smallest details.

UAE Tax for Expats & Their Home Country

A zero-tax country is only half the answer — the question that decides the bill is whether the country you came from still treats you as resident.

LRS limits & TCS on remittances — questions we are asked

Do I file LRS limits & TCS on remittances even if no tax is owed?

Information return obligations of this kind are generally required on the facts rather than on the tax result, so a nil position does not remove one. Resident individuals remitting funds abroad and families funding education or property purchases overseas.

What happens if I have missed LRS limits & TCS on remittances for several years?

Missed years are dealt with as a package rather than one at a time, because the route chosen for the first year affects the relief available for the rest. We map the years and the obligations before anything is filed.

Is LRS limits & TCS on remittances the same as the other reports I already file?

No. How the remittance scheme's annual limit and the tax collected at source on outward remittances work together. Satisfying a different obligation, even one covering the same accounts or entity, does nothing for this one.

What are Forms 15CA and 15CB for?

They clear a payment out of India. Form 15CA is the remitter's declaration of the payment and the tax withheld on it; Form 15CB is an accountant's certificate on the taxability of the amount, the treaty article relied on and the correct withholding rate. The bank generally will not execute the transfer without them, in the categories where they are required. The work is deciding the rate correctly, because the certificate is the record of that decision. See 15CA and 15CB certification.

Is my Indian provident fund or PPF still tax-free now that I live abroad?

The exemption is an Indian one, and it does not travel. Your new country of residence taxes worldwide income under its own rules, and several — the United States in particular — may treat the annual growth in a foreign retirement or savings plan as currently taxable and separately reportable, whether or not you withdrew anything. So an account that is genuinely tax-free in India can be a taxable, reportable asset where you now live. See Indian pensions received abroad.

How is foreign tax credit claimed in India?

By furnishing Form 67 with proof of the foreign tax — the certificate or statement from the other country's authority or payer — and by relieving the income under the specific DTAA article rather than generally. The credit is limited to the Indian tax on that income, and it is computed source by source rather than in one pool. The deadline for furnishing Form 67 has been amended more than once, so we confirm it for the year rather than assume. See foreign tax credit in India.
