Start with the mechanism, not the form. Two people with identical incomes and identical passports can owe completely different amounts because one of them falls inside a provision the other does not. The arithmetic is more persuasive than the description, so:

Two countries tax slices of one gain: C$29,676 and C$153,324 on this apportionment. Where their taxing points differ — grant, vest, exercise or sale — the credit can arrive in a year the other country is no longer taxing, which is the mismatch to plan around. The interesting question is where your own figures fall relative to that, which is a computation rather than an opinion.

The credit absorbs C$31,460 and leaves C$18,150 payable at home, because the home rate on this income is the higher of the two. The balance is real cash and it is due on the home timetable, which is why instalments get raised in the first meeting. Your version of this table is the useful one, and it takes a short call and a document pack to produce.

These amounts illustrate the mechanism only. The rates and thresholds are assumptions of the example, not your numbers: each is checked against the issuing authority for your specific tax year before any return is filed.

Four terms worth pinning down

Beneficial ownership
The test that a treaty rate belongs to the person entitled to use and enjoy the income, not to an intermediary obliged to pass it on.
PAN
India's permanent account number — the identifier every Indian filing, refund and treaty claim depends on, and the first bottleneck in an NRI file.
Chapter 3 withholding
The US regime for withholding on US-source payments to foreign persons, operated through foreign-status certificates and recipient statements.
Clubbing of income
The Indian attribution of income back to a transferor where assets were transferred to a spouse or certain relatives without adequate consideration.

What makes management consultants different from an ordinary filing?

An ordinary preparer applies the general rule and stops there, which is how the relief in the specific provision goes unclaimed.

Can you work with my existing accountant?

That is how most of these engagements run. They keep the domestic file, we take the cross-border piece, and the boundary is agreed in writing so nothing is done twice or missed.

What is a permanent establishment, and how easily do we create one?

A taxable presence in another country under the treaty — typically a fixed place of business such as an office, branch, factory or workshop, or a dependent agent habitually concluding contracts on your behalf. Some treaties add a services test measured in days. Purely preparatory or auxiliary activity is excluded, but that carve-out is narrower than it sounds: one senior employee working from home in the other country, with authority, has been enough. What happens if I have not filed for several years?

Missed years are handled as one package, not one at a time, because the route chosen for the first year determines the relief available for the rest. Each country has a disclosure or relief programme with its own conditions, and entering the right one — before the authority contacts you — is usually what keeps penalties down. Will you tell me what I could have done differently?

Yes, including where the window has closed. Knowing that a step was available last year is the reason next year is cheaper.

How do you decide what is out of scope?

It is written down before we start. Anything not named in the scope is quoted separately rather than assumed, which is what stops the fee moving.
