In short

A developer working remotely for a foreign employer can create a taxable presence for that employer in the country where the code is written — which turns a personal arrangement into the employer's problem.

On this page: the rule that applies here, the questions we are asked first, two finished files with their numbers, how an engagement runs, and the fee it starts from.

The rule that applies to this group and not the one next to it

A developer working remotely for a foreign employer can create a taxable presence for that employer in the country where the code is written — which turns a personal arrangement into the employer's problem.

Here is the part that decides your answer. Two people with identical incomes and identical passports can owe completely different amounts because one of them falls inside a provision the other does not. That is the whole reason this page exists as its own page rather than as a paragraph on a general one.

The team at work in the open-plan office

Software developers your filing calendar — priced before we start

A software developer's filing calendar decides the fee more than any single return does: how many returns and disclosures fall due in a year, in how many countries, and how many of them are already late. One home return with one foreign account is a short calendar; two payrolls and back years are not.

Three things we hear on the first call

  • My employer has no entity where I live and does not want one.
  • I am paid in a foreign currency into a foreign account and report neither properly.
  • My share options were granted in one country and vested after I moved.

Every one of those is a question we answer weekly. They arise because two tax systems were written independently and neither was designed with the other in mind. See also tax for physicians & surgeons.

The numbers, end to end

Put numbers against it and the shape of the answer is obvious.

Equity that vests after the move

A grant worth C$163,000 at vest, over a 48-month vesting period, 26 months of which were worked in the first country and 22 in the second.

Equity that vests after the move
ItemAmount
Value at vestC$163,000
Vesting period (months)48
Months worked in the first country26
Months worked in the second country22
Apportioned to the first countryC$88,292
Apportioned to the second countryC$74,708

Two countries tax slices of one gain: C$88,292 and C$74,708 on this apportionment. Where their taxing points differ — grant, vest, exercise or sale — the credit can arrive in a year the other country is no longer taxing, which is the mismatch to plan around. The shape of that result holds; the size of it depends entirely on your own numbers and dates.

These amounts illustrate the mechanism only. The rates and thresholds are assumptions of the example, not your numbers: each is checked against the issuing authority for your specific tax year before any return is filed.

The numbers, end to end

The same point, with figures rather than adjectives.

Credit relief on one stream of income

Take C$85,000 of income taxed in both countries. Assume the other country charged 32% on it and the home country would charge 40% on the same amount.

Credit relief on one stream of income
ItemAmount
Income taxed in both countriesC$85,000
Tax paid abroad (assumed 32%)C$27,200
Home tax on the same income (assumed 40%)C$34,000
Credit available (lesser of the two)C$27,200
Home tax still payableC$6,800

The credit absorbs C$27,200 and leaves C$6,800 payable at home, because the home rate on this income is the higher of the two. The balance is real cash and it is due on the home timetable, which is why instalments get raised in the first meeting. The shape of that result holds; the size of it depends entirely on your own numbers and dates.

The figures here are an illustration, not an engagement: amounts are picked so the mechanism is easy to follow, and every rate or threshold is an assumption of the example. Before anything is filed for you, each one is confirmed with the issuing authority for your own tax year.

How the engagement runs

  1. 1A first call to map the obligations across every country involved
  2. 2A single fixed fee covering the whole set, agreed before we begin
  3. 3Preparation in the order that makes the relief usable, with a reviewer's sign-off
  4. 4You approve the finished work, and we file it
  • Authorisation with each authority, so we see the assessments and slips directly rather than asking you for them.
  • A 24-hour helpline, +1 (416) 619-0068, before you commit to anything.
  • Nothing is filed until you have read it.

How to get this moving

If you already have an adviser, we will tell you what they should be asking rather than replacing them.

International tax accountant — what this page covers

Read this page for international tax accountant. It works through software developers: your filing calendar from the beginning — whether it applies to you at all, what has to be filed if it does, and what the engagement costs, priced up front.

The four phases of the work

  1. Start with a conversation about the facts

Dates, residence, where the income arose. Fifteen minutes is usually enough to know what applies.

  2. Scope and price, both written down

You get the scope and the fixed fee together, so there is no question later about what was included.

  3. Prepared by one team, reviewed by a named practitioner

The same people see both sides of the file, and the reviewer signs their name to it.

  4. Filed, then followed through

Submission is not the end of the engagement — the queries that arrive afterwards are part of it.

Four terms worth pinning down

Form 3CEB
The Indian accountant's report on international related-party transactions, mandatory regardless of transaction size.
NRO account
A rupee account for a non-resident's Indian-source income, whose interest is generally taxable in India with deduction at source.
Streamlined filing
The US catch-up route for non-willful filers, requiring a limited number of back returns and account reports plus a signed certification. Availability ends when the IRS makes contact first.
Foreign grantor trust
A non-US trust with a US settlor treated as grantor, bringing US information reporting and taxation of the trust's income to that settlor.

Software developers your filing calendar — what the published fees look like

The fees in this row are for individual dates on that calendar — a foreign account disclosed, an instalment position settled, a year filed late and brought current. What moves each is whether a developer's records for that year still exist or have to be rebuilt from bank and payroll statements.

What working with us on software developers your filing calendar looks like

The reporting penalties get named early

The heaviest exposure on a cross-border file is usually a disclosure form, not the tax. We identify which ones apply before a deadline turns into a penalty.

Every figure on a page is traceable

Where a rate or a threshold appears in our writing it names the tax year it belongs to. Where it could not be confirmed, the page describes the mechanism and quotes no number.

The quote comes from your documents

Nothing is priced from a phone call. We read what you have first, then the fee is set — so the scope and the number are agreed on the same evidence.

Late and missed years are ordinary work

An unfiled history is not a reason to wait longer. We assess what is still open and what relief the delay attracts before the first return goes in.

How the work runs — quote first, then the work

  • Step 1: Send what you already have – Slips, statements, prior returns — in any order. We list what is still needed after reading them.
  • Step 2: A fee agreed in writing – Quoted from those documents, before the work starts, and it does not move once you accept it.
  • Step 3: Each side drafted against the other – The returns are built together rather than in sequence, so relief is claimed once and in the right country.
  • Step 4: You approve before it is filed – The finished return comes to you first. Nothing is submitted on your behalf unseen.

Quoted up front, in writing.

Case study 1

A Second Opinion on a Return Already Filed

A cross-border return prepared on one side only is usually right in isolation and wrong in combination. The review checks residence, source and relief in that order, and says plainly whether an amendment is worth making.

Read how this one runs
Case study 2

A Residency Determination Review After Leaving the Country

Residence is decided on ties, not on a form, and the review asks for evidence of every one of them. The file assembles the ties that were severed and the ones that remained, and answers the questionnaire against the treaty rather than around it.

Read how this one runs
Case study 3

Green Card Kept, Moved to Canada — Both Returns Still Due

Holding a green card does not end the US filing obligation, and living in Canada starts a Canadian one. The engagement fixes residence under the treaty tie-breaker, then decides which return the relief is claimed on so the two do not contradict each other.

Read how this one runs
Case study 4

The Two-Year Window After Returning to India

Returning residents pass through a transitional status in which foreign income is largely outside the Indian net. The engagement establishes when the window opens and closes, and puts the transactions that benefit inside it.

Read how this one runs
Case study 5

An IRS Notice for a Year the Client Believed Was Settled

Most notices are proposals rather than assessments, and they carry a response window that is shorter than it looks. The engagement reads what is actually being proposed, gathers the support, and replies inside the window with the position rather than a request for time.

Read how this one runs
Case study 6

A Canadian Working in the US on a Work Visa

Immigration status and tax residence are different tests, and a visa says nothing about which country taxes the salary. The file fixes residence, applies the employment article, and sequences the two returns so the credit lands where it is usable.

Read how this one runs
Case study 7

Coming Back to Canada After Years Abroad

Returning restarts Canadian residence and re-values what you own on the day you arrive. Foreign pensions, employer plans and accounts opened abroad each land differently, and the reporting thresholds are tested against the whole portfolio rather than each account.

Case study 8

An Assignment Priced Without Counting the Days

Nearly every relief in a mobility file — treaty exemption, residence, social security — is decided by a day count that has to be evidenced. The engagement puts the tracking in place at the start, because it cannot be reconstructed at the end.

Core International & Cross-Border Tax Services

International Tax Planning & Advisory

Strategy and compliance for income, assets and families spread across borders.

One coordinating team: filings on every side of the border are sequenced so treaty relief and foreign tax credits are claimed once — and in the right country.

U.S. & Cross-Border Tax Returns

Dual filers: U.S. citizens in Canada and Canadians with U.S. income run two parallel systems — we prepare both, in the right order, every year.

Expat & Emigration Tax

The move year is its own project: the elections and valuations filed that year decide the next decade of both countries’ returns.

Non-Resident Canadian Tax

Default withholding is 25% of gross: elective returns routinely turn over-withheld rent and pensions into refunds.

Transfer Pricing & BEPS

Documentation prepared with the return is the cheapest insurance in international tax; reconstructing it during an audit is the most expensive.

Cross-Border Estates & Trusts

Wills drafted for one country routinely misfire in the other — deemed disposition here, estate tax there, credits in between.

Cross-Border Corporate Tax

Expansion raises the same four questions every time — entity, PE, repatriation, payroll. We answer them before the tax authorities do.

India Tax for NRIs & Returning Residents

The deduction is taken on the sale price, not the gain — which is why an NRI property sale strands cash unless the certificate is applied for before closing.

Canadian Tax with a Foreign Element

Residency is decided on facts, not on a form — and the year you arrive or leave is the one where the largest amounts turn on the smallest details.

UAE Tax for Expats & Their Home Country

A zero-tax country is only half the answer — the question that decides the bill is whether the country you came from still treats you as resident.

Firms and partners working across borders meet Regulation 105 withholding, PE risk on long engagements and per-country payroll for travelling staff.

A partnership is taxed in the hands of its partners, so one engagement abroad can reach every partner's personal return. The order matters: the waiver is applied for before the invoice, the presence is tracked before it becomes an establishment, and the payroll is registered before the first day worked in the other country.

Software developers — your filing calendar — questions we are asked

What makes software developers different from an ordinary filing?

A developer working remotely for a foreign employer can create a taxable presence for that employer in the country where the code is written — which turns a personal arrangement into the employer's problem. An ordinary preparer applies the general rule and stops there, which is how the relief in the specific provision goes unclaimed.

Can you work with my existing accountant?

That is how most of these engagements run. They keep the domestic file, we take the cross-border piece, and the boundary is agreed in writing so nothing is done twice or missed.

How much foreign income is tax-free in Canada?

None of it is tax-free for being foreign. A Canadian resident is taxed on worldwide income, so foreign salary, interest, dividends, rent and gains all go on the return, converted to Canadian dollars. What genuinely reduces the bill is the basic personal amount, the credit for foreign tax already paid, and any treaty article that exempts a specific type of income. The reporting thresholds people have in mind — the foreign property statement, for one — govern reporting, not exemption. See the foreign tax credit.

Is double taxation illegal?

It is legal. Two countries can each have a valid claim on the same income — one because the income arose there, the other because you live there — and nothing prohibits both from exercising it. What exists instead is relief: tax treaties allocate the claim, and domestic law gives a credit for foreign tax paid. The relief is not automatic, though. It is claimed on a return, and unclaimed relief is simply lost. See how double taxation is relieved.

What is the most common thing you find on a review?

An unclaimed foreign tax credit, a missed information return, and a treaty position taken without the disclosure the rules required. Usually all three.

Will this trigger an audit?

Filing correctly does not create risk; a pattern of missing filings does. Where a disclosure route is involved we set out what the authority will see and in what order before you commit to it.
