A dual claim on the same period is settled by whichever treaty test resolves first. In practice that is normally the permanent home or the centre of vital interests, which is why leases, school records and family location matter more than any later explanation.

Zambia — questions we are asked

Do I have to file at home while living in Zambia?

Residence decides it, and residence is a question of facts rather than of where your post arrives. The one exception is US citizenship, which carries the filing obligation with the person wherever they go. So the first thing we establish is which system still claims you.

Is there a treaty between my country and Zambia?

That is verified rather than assumed: we confirm which treaty text governs Zambia and your home country for the year in question, because a protocol can move a rate or an article between years. If there is no treaty, unilateral credit rules are what prevent double taxation.

I own property in Zambia. Where is the rent taxed?

In Zambia, because that is where the property sits. The complication is the base: gross-rent withholding takes no account of mortgage interest, tax or repairs, so a leveraged property can face tax on turnover. An election onto net profit, where it exists, is what fixes that — and it has its own timing.

Does foreign employment income create RRSP room?

Only where it is earned income reported on a Canadian return. RRSP room is built from earned income that Canada sees, so a non-resident year of foreign salary generally builds none, and foreign tax paid does not create room of its own. This is why people returning to Canada after years abroad find their contribution room much smaller than the years elapsed suggest, and why the notice of assessment is the only reliable statement of it. Do green card holders living abroad have to file US taxes?

Yes. A lawful permanent resident is a US tax resident, taxed on worldwide income, and that status does not end simply because you moved away — it ends when it is formally abandoned or administratively terminated. Two traps follow. Filing as a non-resident on a treaty claim can put the immigration status itself at risk. And ending the status after holding it long-term can bring you inside the expatriation regime. See giving up a green card.

Does California allow the foreign earned income exclusion?

No. California does not conform to it, so foreign salary a resident excludes on the federal return is still in the California base — and California does not give a credit for foreign tax in the way it does for tax paid to other states. The result is the same income taxed federally at zero and by California in full. Whether it applies at all comes back to whether you are still a California resident, which is the question worth answering first. See state residency and domicile.
