When it is due

The return is due on the entity's own filing timetable, measured from its year end rather than the calendar. Extensions may be available for the return and rarely cover the payment, and in a cross-border group the binding constraint is usually the date the foreign accounts close. The deadline is set out in writing with the engagement, along with what has to be in our hands to meet it.

What late or missed filing costs

Late filing penalties are computed by reference to the tax owing and the length of the delay, and separate penalties attach to the information returns filed alongside. In a group the second category is normally the larger one. Relief exists for most of these situations, and it is conditional on how the correction is made. That is the part worth getting right.

Here is the rule doing its work on an actual set of amounts.

Take C$145,000 of income taxed in both countries. Assume the other country charged 18% on it and the home country would charge 36% on the same amount.

The credit absorbs C$26,100 and leaves C$26,100 payable at home, because the home rate on this income is the higher of the two. The balance is real cash and it is due on the home timetable, which is why instalments get raised in the first meeting. Your version of this table is the useful one, and it takes a short call and a document pack to produce.

These amounts illustrate the mechanism only. The rates and thresholds are assumptions of the example, not your numbers: each is checked against the issuing authority for your specific tax year before any return is filed.

Do I file Form ITR-7 even if no tax is owed?

Annual return obligations of this kind are generally required on the facts rather than on the tax result, so a nil position does not remove one. Indian trusts and institutions, including those receiving foreign contributions.

What happens if I have missed Form ITR-7 for several years?

Missed years are dealt with as a package rather than one at a time, because the route chosen for the first year affects the relief available for the rest. We map the years and the obligations before anything is filed.

Is Form ITR-7 the same as the other reports I already file?

No. The return for trusts, institutions and entities claiming exemption under the charitable and religious provisions. Satisfying a different obligation, even one covering the same accounts or entity, does nothing for this one.

What is a DTAA?

Double Taxation Avoidance Agreement — India's name for a tax treaty. It does the same work as any treaty: allocates taxing rights between India and the other country, caps Indian withholding on payments abroad, and sets out whether relief comes by exemption or by credit. To use one you generally need a tax residency certificate from the other country, Form 10F, and a PAN in the deductor's records. See DTAA relief between India and Canada.

What is Schedule FA and who has to complete it?

It is the foreign asset disclosure in an Indian return, and the trigger is residential status rather than income: a resident discloses foreign bank accounts, custodial and equity holdings, foreign life insurance with a cash value, immovable property and other assets held at any time in the year, plus any beneficial interest. A non-resident does not. The obligation is disclosure-based, so it applies to an account that earned nothing, and the penalties under the black-money legislation are what make it worth getting right. What is TCS on foreign remittance?

Tax collected at source. When a resident individual remits money abroad under the Liberalised Remittance Scheme — or buys an overseas tour package — the bank or seller collects an amount of tax on top and deposits it against your PAN. It is not a cost and it is not a final tax: it appears in your annual tax statement and is set off against the tax on your return, with the excess refunded. The rates and the purposes they attach to have been amended repeatedly, so we confirm them for the remittance year. See LRS limits and TCS.
