In short

Software and subscription revenue is characterised differently across jurisdictions — as services, as royalties, or as a digital supply — and the characterisation changes both withholding and indirect tax.

On this page: the rule that applies here, the questions we are asked first, two finished files with their numbers, how an engagement runs, and the fee it starts from.

The rule that applies to this group and not the one next to it

Software and subscription revenue is characterised differently across jurisdictions — as services, as royalties, or as a digital supply — and the characterisation changes both withholding and indirect tax.

Start with the mechanism, not the form. Two people with identical incomes and identical passports can owe completely different amounts because one of them falls inside a provision the other does not. That is the whole reason this page exists as its own page rather than as a paragraph on a general one.

Fixed fees for technology & saas what we charge, agreed up front

What we charge a technology or SaaS company is set from the shape of the group: how many entities file, how many countries the engineers and the customers sit in, and whether subscription revenue has been characterised consistently across the contracts. You send the documents, the fee is agreed in writing, and then the work begins.

Three things we hear on the first call

  • Some customers withhold tax on our invoices and others do not.
  • We have engineers in three countries and one corporate entity.
  • Our contracts were written domestically and we now sell globally.

That list is the reason this desk exists. Individually each question has an answer; together they need someone who holds both systems at once. See also Canadian with foreign inheritance.

The numbers, end to end

Put numbers against it and the shape of the answer is obvious.

Equity that vests after the move

A grant worth C$104,000 at vest, over a 36-month vesting period, 24 months of which were worked in the first country and 12 in the second.

Equity that vests after the move
ItemAmount
Value at vestC$104,000
Vesting period (months)36
Months worked in the first country24
Months worked in the second country12
Apportioned to the first countryC$69,333
Apportioned to the second countryC$34,667

Two countries tax slices of one gain: C$69,333 and C$34,667 on this apportionment. Where their taxing points differ — grant, vest, exercise or sale — the credit can arrive in a year the other country is no longer taxing, which is the mismatch to plan around. The shape of that result holds; the size of it depends entirely on your own numbers and dates.

An illustration, not a client file. The sums are chosen for legibility and the thresholds are stated for the example alone — nothing reaches a filing until it has been confirmed at source for your own year.

Worked through with figures

It is easier to see with numbers attached.

Credit relief on one stream of income

Take C$90,000 of income taxed in both countries. Assume the other country charged 32% on it and the home country would charge 26% on the same amount.

Credit relief on one stream of income
ItemAmount
Income taxed in both countriesC$90,000
Tax paid abroad (assumed 32%)C$28,800
Home tax on the same income (assumed 26%)C$23,400
Credit available (lesser of the two)C$23,400
Home tax still payableC$0

The credit fully absorbs the home liability on this income, so nothing further is payable at home — but the return still has to be filed and the credit still has to be claimed, by category and by country. Change any one of those inputs and the answer moves, which is why we run it on your own figures rather than on an illustration.

Example figures throughout, selected to make the rule visible, with rates and thresholds assumed for the demonstration. Your actual filing uses figures confirmed with the issuing authority for your tax year.

How we handle it

  1. 1A call to the 24-hour helpline to find out whether this is a filing or a project
  2. 2A fixed fee for a written scope — re-quoted if the scope changes, never invoiced silently
  3. 3Preparation against the evidence, with the positions documented as we go
  4. 4Your approval, then the filing — in that order
  • Documents move through an access-controlled portal rather than email.
  • We will tell you when you do not need us, and that call is free.
  • 18,000+ clients served across 4 global offices: India, the USA, Canada and the UAE.

Your next step

One call now is worth more than a filing season of guessing.

International tax accountant — what this page covers

Most readers of this page are looking for international tax accountant. What follows sets out how it works for technology & SaaS: what we charge: who is caught by it, what has to be filed, and what the work costs, agreed before it begins.

From first contact to filed return

  1. Send what you already have

Slips, statements, prior returns — in any order. We list what is still needed after reading them.

  2. A fee agreed in writing

Quoted from those documents, before the work starts, and it does not move once you accept it.

  3. Each side drafted against the other

The returns are built together rather than in sequence, so relief is claimed once and in the right country.

  4. You approve before it is filed

The finished return comes to you first. Nothing is submitted on your behalf unseen.

CFC

Foreign earned income
Wages and self-employment income for services performed outside the country. Only earned income qualifies for the US exclusion; investment income does not.

The published fees closest to technology & saas what we charge

A first year for a SaaS group usually costs more than the years after it, because the characterisation of the revenue and the withholding position have to be settled once and then only maintained. The band below is where an established file sits when nothing structural has changed.

You are not the go-between for two sets of advisers with two sets of assumptions. One engagement covers each country the file touches.

You deal with the person who did the work

Cross-border situations we are engaged for

Case study 1

Social Security Contributions Owed in Two Countries at Once

A totalization agreement assigns contributions to one system and exempts the other, but only against a certificate obtained in advance. Without it both sets come out of the same salary and neither is straightforward to recover.

Read how this one runs
Case study 2

Wintering in the US Long Enough to Become a US Filer

Days in the United States accumulate across three years, and enough of them make you a US resident for tax regardless of immigration status. The file counts the days properly and files the statement that keeps the position closer connection rather than residence.

Read how this one runs
Case study 3

A TFSA That Costs More Than It Saves

Canadian tax-free accounts are not tax-free to a US person, and some of them carry a reporting form of their own. The file is a review of what is held, what each account triggers on the US side, and whether the account is worth keeping once the reporting is priced in.

Read how this one runs
Case study 4

Coming Back to Canada After Years Abroad

Returning restarts Canadian residence and re-values what you own on the day you arrive. Foreign pensions, employer plans and accounts opened abroad each land differently, and the reporting thresholds are tested against the whole portfolio rather than each account.

Read how this one runs
Case study 5

Whether the Year Made Someone an NRI

Indian residence is decided by presence tests applied to the financial year, and a single trip can change the answer for the whole of it. The status is established before any return or exemption is considered.

Case study 6

Unreported Foreign Income Disclosed Before the CRA Asked

A voluntary disclosure has to be genuinely voluntary — once a letter arrives, the route usually closes. The engagement establishes whether the programme is still available, prepares the years, and puts the relief request in with the filing rather than after it.

Read how this one runs
Case study 7

First Canadian Return After Arriving Mid-Year

The arrival date splits the year and sets the cost base of what you brought with you. Getting that date and those values right is what determines whether a later sale is taxed on the whole gain or only on the part that accrued after landing.

Case study 8

A Foreign Property Form Filed Late, With Penalties Running Daily

The foreign asset return carries a penalty that accrues per day rather than per return, so the exposure grows quietly. Relief is discretionary and it is granted on the reasons given, which means the request is the work rather than the form.

Core International & Cross-Border Tax Services

International Tax Planning & Advisory

Strategy and compliance for income, assets and families spread across borders.

One coordinating team: filings on every side of the border are sequenced so treaty relief and foreign tax credits are claimed once — and in the right country.

U.S. & Cross-Border Tax Returns

Dual filers: U.S. citizens in Canada and Canadians with U.S. income run two parallel systems — we prepare both, in the right order, every year.

Expat & Emigration Tax

The move year is its own project: the elections and valuations filed that year decide the next decade of both countries’ returns.

Non-Resident Canadian Tax

Default withholding is 25% of gross: elective returns routinely turn over-withheld rent and pensions into refunds.

Transfer Pricing & BEPS

Documentation prepared with the return is the cheapest insurance in international tax; reconstructing it during an audit is the most expensive.

Cross-Border Estates & Trusts

Wills drafted for one country routinely misfire in the other — deemed disposition here, estate tax there, credits in between.

Cross-Border Corporate Tax

Expansion raises the same four questions every time — entity, PE, repatriation, payroll. We answer them before the tax authorities do.

India Tax for NRIs & Returning Residents

The deduction is taken on the sale price, not the gain — which is why an NRI property sale strands cash unless the certificate is applied for before closing.

Canadian Tax with a Foreign Element

Residency is decided on facts, not on a form — and the year you arrive or leave is the one where the largest amounts turn on the smallest details.

UAE Tax for Expats & Their Home Country

A zero-tax country is only half the answer — the question that decides the bill is whether the country you came from still treats you as resident.

Investment Funds & Holding Companies

Holding structures live or die on treaty access, beneficial ownership and substance — the MLI's principal-purpose test now sits over every arrangement.

A holding structure is only as good as its reporting. Foreign affiliates, accrued passive income and distributions each carry their own return, and the penalties on those attach to the form rather than to any tax being owed — so a structure that saves tax can still cost money if the information returns are late.

Technology & SaaS — what we charge — questions we are asked

What makes technology & saas different from an ordinary filing?

Software and subscription revenue is characterised differently across jurisdictions — as services, as royalties, or as a digital supply — and the characterisation changes both withholding and indirect tax. An ordinary preparer applies the general rule and stops there, which is how the relief in the specific provision goes unclaimed.

Can you work with my existing accountant?

That is how most of these engagements run. They keep the domestic file, we take the cross-border piece, and the boundary is agreed in writing so nothing is done twice or missed.

Do NRIs pay tax on money sent to India?

Sending your own funds to India is a transfer of capital, not income, so the remittance itself is not taxed. What is taxable is income the money then earns in India — interest, rent, capital gains — under the rules for the account type it sits in. Sending money out of India is the direction that needs certification before the bank will act. See NRE, NRO and FCNR accounts.

Is double taxation legal?

Yes. Nothing prevents two countries from taxing the same income under their own domestic law — each is exercising its own jurisdiction. What treaties and credit systems do is relieve the outcome rather than prohibit the charge, and relief is generally something you must claim on a return or a form, not something applied automatically. Miss the claim and the double charge stands. Double taxation explains the mechanism.

Is there a minimum engagement?

No, but there is a minimum that makes sense: below a certain scope the honest answer is often that you can handle it yourself, and we will say so.

Do you charge for the first meeting?

No. The helpline is open 24 hours a day and the first call is free, and if the conclusion is that there is no work to do we tell you that on the call.
