How the rule actually works

A parent guarantee has value only to the extent it improves the borrower's terms beyond the benefit of merely belonging to the group — and that implicit support is not chargeable.

The fee is priced on the interest saved relative to a standalone borrowing, split to reflect the guarantor's risk. Documenting the yield-approach computation is what distinguishes a chargeable guarantee from passive association.

What that means in practice is that the work happens before the filing season, not during it. By the time a return is being prepared the facts are fixed; everything that could have changed the answer — a date, an election, a certificate, a valuation — had its own window, and most of those windows close earlier than people expect.

Thresholds and rates move, and summaries written for last year are not evidence about this one. So each figure in your file is sourced to the issuing authority for the specific year; anything we cannot source, we describe as a mechanism and leave unquantified until it can be confirmed. The reported margin sits inside the tested range, which is the outcome documentation is meant to demonstrate. Keep the study current: a range computed three years ago is not evidence about this year. Four terms worth pinning down

Form 8865
The US information return for an interest in a foreign partnership, including contributions and dispositions.
FTC basket
A category into which foreign income and foreign tax are grouped for credit purposes. Credit in one basket cannot shelter tax in another, which is why sourcing work matters.
Adjusted cost base
The tax cost of property, from which a gain or loss is computed. It resets on arrival in a country and is deemed on emigration.
FC-GPR
The Indian reporting of shares issued to a foreign investor, due within days of the transaction and compounding if late.

Guarantee fee pricing — is this a do-it-yourself job?

Some of it, yes — and we will say so on the call if that is the honest answer. The parts that are worth paying for are the ones where a missed election, a missed deadline or an unverified threshold costs more than the fee: the fee is priced on the interest saved relative to a standalone borrowing, split to reflect the guarantor's risk.

What if I have already filed and got it wrong?

That is a common starting point. We re-derive the position, identify whether an amendment or a disclosure route is the right vehicle, and tell you which one preserves the relief that is still available. The order matters more than the speed.

How long will it take?

It depends on the documents rather than on us. Once the pack is complete most filings turn around inside a fortnight; anything that needs a certificate from a tax authority runs on that authority's timetable, which we tell you at the start rather than at the end.

What does a transfer pricing benchmarking study do?

It evidences that your related-party pricing sits within the range independent parties achieve. The work is comparison: identify companies or transactions genuinely similar in function, risk and assets, compute their margins, and show where your result falls against that range. Done before the filing deadline it supports the position; produced afterwards under audit it carries far less weight. See benchmarking study.

What is country-by-country reporting?

A report that the largest multinational groups file with their home authority, setting out revenue, profit, tax paid and accrued, capital, employees and tangible assets for every jurisdiction they operate in. It is exchanged between authorities and used for risk assessment, not to compute tax. Its effect on the ground is that inconsistency between the report, the local files and the statutory accounts is itself what draws attention. See our transfer pricing work.

What are the transfer pricing methods?

Five, in two groups. Three compare transactions: comparable uncontrolled price, resale price, and cost plus. Two compare profits: the transactional net margin method, and profit split. The OECD asks for the most appropriate method on the facts rather than a fixed hierarchy; the United States applies a best-method rule to similar effect. Selection is itself a documented judgment, and a method chosen without recording why is a weak position under audit. See our transfer pricing work.

What happens after the filing?

You get the filed copies and a note of anything due next year, with the dates. Where an authority responds, that correspondence comes to us if the authorisation is in place.

Do you give a written opinion?

Where the position warrants one, yes — with the reasoning, the authority relied on, and what would change the answer. It is quoted as part of the scope rather than added afterwards.
