The rule behind the paperwork

India's default deduction is often computed on the whole receipt rather than the profit. The lower-deduction certificate is what aligns the deduction with the actual liability.

The application is made before the payment with computations and supporting evidence, and the certificate is issued for a specified payer, payee and period. Obtained late, the over-deducted amount is recovered only through an Indian return.

This is why we start with a chronology rather than a form. Almost every position in this area is anchored to a date — of arrival, of departure, of a payment, of a transaction — and the evidence that supports it is either created around that date or reconstructed years later at several times the cost.

Thresholds and rates move, and summaries written for last year are not evidence about this one. So each figure in your file is sourced to the issuing authority for the specific year; anything we cannot source, we describe as a mechanism and leave unquantified until it can be confirmed. Filing on a net basis recovers C$11,568 of the C$15,000 withheld. That difference is the entire reason the elective return exists, and it is lost by not filing. The shape of that result holds; the size of it depends entirely on your own numbers and dates.

Lower or nil TDS certificate under section 197 — where does doing it myself start to cost money?

Some of it, yes — and we will say so on the call if that is the honest answer. The parts that are worth paying for are the ones where a missed election, a missed deadline or an unverified threshold costs more than the fee: the application is made before the payment with computations and supporting evidence, and the certificate is issued for a specified payer, payee and period.

What if I have already filed and got it wrong?

That is a common starting point. We re-derive the position, identify whether an amendment or a disclosure route is the right vehicle, and tell you which one preserves the relief that is still available. The order matters more than the speed.

How long will it take?

It depends on the documents rather than on us. Once the pack is complete most filings turn around inside a fortnight; anything that needs a certificate from a tax authority runs on that authority's timetable, which we tell you at the start rather than at the end.

What does an application under section 197 actually ask for?

It asks the Indian tax authority to certify, in advance, that tax should be deducted from your receipts at a lower rate than the default, or not deducted at all. The case is made on the arithmetic: what the income will be, what the tax on it will actually come to, and why deducting at the standard rate would withhold far more than the year's liability. A certificate under section 197 is issued for a period and for named payers, so the application is prepared with the payment schedule in front of it.

Does dual citizenship affect Social Security benefits?

Entitlement is built on your contribution record and on the rules of the paying system, not on how many passports you hold. What your citizenship and residence do affect is the tax side: which country may tax the benefit under the treaty's pensions or social security article, whether the payer withholds, and whether a totalization agreement joins two contribution records to get you over an eligibility threshold. What is TCS on foreign remittance?

Tax collected at source. When a resident individual remits money abroad under the Liberalised Remittance Scheme — or buys an overseas tour package — the bank or seller collects an amount of tax on top and deposits it against your PAN. It is not a cost and it is not a final tax: it appears in your annual tax statement and is set off against the tax on your return, with the excess refunded. The rates and the purposes they attach to have been amended repeatedly, so we confirm them for the remittance year. See LRS limits and TCS.

What happens if two countries both say I am resident?

The treaty tie-breaker resolves it to one residence, applied in order: where your permanent home is, then your centre of vital interests, then your habitual abode, then nationality, with a competent-authority referral if all of those fail. It is an evidence exercise rather than an election — you document the home and the life around it. Getting a single residence settled is what makes every other position in both returns consistent.
