Do you still file at home?

The question is really "did the home country let go", and only one of the three ever does automatically. Canada does, once the ties end. India does, subject to the day counts. The United States does not, while the citizenship or the green card is held.

Residency and the tie-breaker

Where both countries claim you as a resident for the same period, a treaty — if one is in force between New Zealand and your home country — resolves it with an ordered set of tests: permanent home first, then centre of vital interests, then habitual abode, then nationality, with agreement between the two authorities as the final step. The case is built around whichever test decides it, which is why the evidence is assembled before the return rather than after a query.

Any treaty claim starts with confirming the agreement in force between your home country and New Zealand for the year — and reading the article as modified rather than as originally signed. That single step prevents most refused relief claims we see.

The credit absorbs C$28,620 and leaves C$7,420 payable at home, because the home rate on this income is the higher of the two. The balance is real cash and it is due on the home timetable, which is why instalments get raised in the first meeting. Four terms worth pinning down

Liaison office
An Indian form of presence that may not earn income. Exceeding its permitted activities creates a taxable presence.
Foreign grantor trust
A non-US trust with a US settlor treated as grantor, bringing US information reporting and taxation of the trust's income to that settlor.
Dependent agent
A person who habitually concludes contracts, or plays the principal role leading to them, on behalf of a foreign enterprise — creating a taxable presence without premises.

Do I have to file at home while living in New Zealand?

For most people the answer turns on whether the ties that made them resident have actually ended. For a US citizen or green-card holder it does not: the return is due in New Zealand exactly as it would be at home. Everything else on the file follows from which of those you are.

Is there a treaty between my country and New Zealand?

That is verified rather than assumed: we confirm which treaty text governs New Zealand and your home country for the year in question, because a protocol can move a rate or an article between years. If there is no treaty, unilateral credit rules are what prevent double taxation.

I own property in New Zealand. Where is the rent taxed?

Where the property is. That is close to universal, and it usually arrives as withholding on the gross rent rather than as a return on the profit — which is why the election onto a net basis, where New Zealand offers one, is normally the first thing to check. Your home country taxes the same rent and credits what was paid.

How are non-residents taxed on Canadian rental income?

By default the payer or agent withholds a flat rate on the gross rent and remits it, with no deduction for mortgage interest, taxes or repairs. Electing under section 216 lets you file on the net rental result instead, which for most properties recovers a substantial part of what was withheld; an NR6 undertaking filed before the year starts lets the withholding itself be computed on net rather than gross. Do non-residents pay US estate tax?

Yes, on US-situs assets — and with a far smaller exemption than a US citizen or domiciliary receives, which is why exposure can arise at values people assume are safe. US real property, tangible property located there and shares issued by US companies are generally in; foreign-issued securities and certain deposits generally are not. An estate tax treaty, where one exists, can improve the position considerably. See US estate tax for non-resident aliens.

What is FIRPTA withholding?

FIRPTA is the US regime that treats a foreign person's disposition of a US real property interest as taxable and makes the buyer withhold on the gross proceeds to secure it. Because the deduction is on the price rather than the profit, it routinely exceeds the real tax — sometimes on a sale made at a loss.
