Take the three home systems in turn. Canada: worldwide income while resident, Canadian-source income after, with residence decided on facts. The United States: worldwide income for citizens and card holders, in Portugal exactly as at home. India: a day-count test, plus a transitional status that can shelter foreign income for a limited period.

Residency and the tie-breaker

Where Portugal and your home country disagree, the treaty picks one — provided a treaty is in force. The evidence that decides it is contemporaneous and specific, which means it is gathered at the time or reconstructed expensively later.

Any treaty claim starts with confirming the agreement in force between your home country and Portugal for the year — and reading the article as modified rather than as originally signed. That single step prevents most refused relief claims we see.

The credit absorbs C$35,560 and leaves C$6,350 payable at home, because the home rate on this income is the higher of the two. The balance is real cash and it is due on the home timetable, which is why instalments get raised in the first meeting. The shape of that result holds; the size of it depends entirely on your own numbers and dates.

Surplus accounts
The per-affiliate pools that decide how much of a foreign dividend arrives in Canada untaxed. Most groups have never actually computed them.
Form 8858
The US information return for a foreign disregarded entity or foreign branch owned by a US person.
Interquartile range
The middle half of a set of comparable results, commonly used as the acceptable range in a transfer-pricing analysis.

Do I have to file at home while living in Portugal?

For most people the answer turns on whether the ties that made them resident have actually ended. For a US citizen or green-card holder it does not: the return is due in Portugal exactly as it would be at home. Everything else on the file follows from which of those you are.

Is there a treaty between my country and Portugal?

Treaty networks change with each protocol and each multilateral-instrument position, so we confirm the treaty in force for your specific year with the issuing authority rather than relying on a published summary. Where there is none, unilateral relief and domestic law do the work instead.

I own property in Portugal. Where is the rent taxed?

In Portugal, because that is where the property sits. The complication is the base: gross-rent withholding takes no account of mortgage interest, tax or repairs, so a leveraged property can face tax on turnover. An election onto net profit, where it exists, is what fixes that — and it has its own timing.

How do I report the sale of a foreign property?

On your residence-country return, as a disposition, with proceeds and cost base converted at the rates for their own dates. Separately, the country where the property sits may require its own return and may hold back tax at closing until a clearance or certificate is issued — Canada does this for a non-resident vendor, and the United States withholds on a foreign seller of US real property. Can I set up a trust that works in two countries?

You can, but the two systems classify and tax trusts differently enough that a structure which is efficient in one is often a reporting problem in the other — a Canadian family trust with a US beneficiary, or a US revocable trust holding Canadian property, are the classic pairs. Canada's twenty-one-year deemed disposition, the US grantor rules and each country's reporting have to be read together, before drafting rather than after. See cross-border wills and trusts.

Is the sale of foreign property taxable where I live?

For a resident, yes — worldwide gains are taxable, and the gain is computed in your own currency, so the exchange rate at purchase and at sale changes the number even when the local-currency price did not move. The country where the property sits usually taxes it too, often with a withholding or clearance step before closing, and that tax becomes a credit.
