Residency and the tie-breaker

Dual residence is common and it is resolved by sequence, not by argument. If a treaty applies, it asks first where the permanent home is; then where the centre of vital interests lies; then where the habitual abode is; then nationality. Most cases are settled by the first or second test, so that is where the documents should be concentrated.

The credit absorbs C$24,150 and leaves C$11,500 payable at home, because the home rate on this income is the higher of the two. The balance is real cash and it is due on the home timetable, which is why instalments get raised in the first meeting. A contemporaneous record of presence by country. Almost every cross-border employment position depends on one, and almost nobody can produce one after the year has ended.
Adjusted cost base
The tax cost of property, from which a gain or loss is computed. It resets on arrival in a country and is deemed on emigration.
Thin capitalisation
Rules capping the deductible interest of a company funded disproportionately by related-party debt, tested by capital structure rather than by rate.
FC-GPR
The Indian reporting of shares issued to a foreign investor, due within days of the transaction and compounding if late.

Do I have to file at home while living in Portugal?

It depends on residence, not on address — except for US citizens and green-card holders, for whom the answer is yes regardless of where they live. We settle the residence question first, because every other answer follows from it.

Is there a treaty between my country and Portugal?

That is verified rather than assumed: we confirm which treaty text governs Portugal and your home country for the year in question, because a protocol can move a rate or an article between years. If there is no treaty, unilateral credit rules are what prevent double taxation.

I own property in Portugal. Where is the rent taxed?

Rent from immovable property is almost always taxable where the property is situated, frequently by withholding on the gross amount, with your home country taxing the same income and giving credit. A net-basis election, where one exists, is usually the difference between tax on profit and tax on turnover.

Does the Foreign Earned Income Exclusion apply to self-employment tax?

No — it does not reduce self-employment tax at all. The exclusion removes income from income tax only, so a US self-employed person abroad can exclude the profit for income-tax purposes and still owe self-employment tax on it. What can relieve that is a totalization agreement with the country where you actually work, which assigns you to one social-security system instead of both. See totalization agreements.

How do I file US taxes when I am married to a foreign spouse?

Three routes. File separately, listing your spouse as a non-resident alien — which needs either an identification number for them or the accepted notation where none exists. Elect to treat them as a resident and file jointly, gaining the joint brackets and accepting their worldwide income. Or file as head of household if you have a qualifying dependant, which some Americans abroad can do while married. The right answer turns on their income and their assets. What is the treaty saving clause, and why does it matter to Americans abroad?

It is the provision that lets each country keep taxing its own residents and citizens as though the treaty did not exist. Because the United States taxes on citizenship, the saving clause is what stops an American in Canada or India using the treaty to remove US tax on ordinary income. A short list of articles is carved out of it — certain pensions, social security, government service, students — and those exceptions are where a treaty position for a US citizen usually lives.
