Residency and the tie-breaker

When Zimbabwe and your home country both say you are resident, the treaty — where one is in force — produces a single answer rather than a split. It applies its tests in a fixed order, and the practical consequence is that a lease, a school registration or a set of medical records can be worth more to the file than any amount of subsequent explanation.

One check comes before every treaty position: is there a treaty in force for this year, and does the article still read the way it did? Protocols and the multilateral instrument have rewritten parts of the network, so we verify rather than assume.

Currency and remittance constraints affect the conversion and evidencing of local income for the home return. That is the part a general expatriate guide will not tell you, and it is usually the part that decides the number at the bottom of the return.

The credit absorbs C$35,880 and leaves C$14,040 payable at home, because the home rate on this income is the higher of the two. The balance is real cash and it is due on the home timetable, which is why instalments get raised in the first meeting. The interesting question is where your own figures fall relative to that, which is a computation rather than an opinion.

Do I have to file at home while living in Zimbabwe?

Residence decides it, and residence is a question of facts rather than of where your post arrives. The one exception is US citizenship, which carries the filing obligation with the person wherever they go. So the first thing we establish is which system still claims you.

Is there a treaty between my country and Zimbabwe?

Possibly, and the version in force for your year is the one that matters — protocols and multilateral-instrument positions change what a treaty does without changing its name. We check it against the authority rather than a summary. Where no treaty applies, domestic relief takes over.

I own property in Zimbabwe. Where is the rent taxed?

Rent from immovable property is almost always taxable where the property is situated, frequently by withholding on the gross amount, with your home country taxing the same income and giving credit. A net-basis election, where one exists, is usually the difference between tax on profit and tax on turnover.

Where does the exclusion go on the return, and does it change my rate?

It is computed on Form 2555 and carried to the return as a negative adjustment to income, so the excluded amount is out of taxable income. It does not, however, pretend you never earned it: the tax on whatever income remains is calculated as though the excluded amount were still there, so the remaining income is taxed at the rates that apply above it. Deductions and credits attributable to excluded income are also disallowed. See the foreign earned income exclusion.

Does California allow the foreign earned income exclusion?

No. California does not conform to it, so foreign salary a resident excludes on the federal return is still in the California base — and California does not give a credit for foreign tax in the way it does for tax paid to other states. The result is the same income taxed federally at zero and by California in full. Whether it applies at all comes back to whether you are still a California resident, which is the question worth answering first. See state residency and domicile.

What does "RIC" mean on my foreign tax paid statement?

Registered Investment Company — a US mutual fund or ETF. When a fund holds securities from many countries it may report the foreign tax it paid on your behalf without breaking it down by country, using RIC as the country label. You are allowed to use it that way on Form 1116 for that income, which saves you reconstructing a country-by-country split you have no way of knowing. See Form 1116.
