In short

Software and subscription revenue is characterised differently across jurisdictions — as services, as royalties, or as a digital supply — and the characterisation changes both withholding and indirect tax.

Further down: the governing rule, the first-call questions, two completed files with figures, the way the work runs, and where the fee is published.

The rule that applies to this group and not the one next to it

Software and subscription revenue is characterised differently across jurisdictions — as services, as royalties, or as a digital supply — and the characterisation changes both withholding and indirect tax.

The rule underneath it looks like this. The general rules are the same for everyone; the provision that changes the answer is not. That is why a general adviser applies the default and stops, and why the relief written for this group goes unclaimed year after year.

Fixed fees for technology & saas your filing calendar, agreed up front

A filing calendar for a technology and SaaS group is priced on how many returns sit on it: one company or several, the indirect-tax registrations that come with selling subscriptions into each market, and whether any of last year's filings are still outstanding. The fee is set in writing before work starts.

Three things we hear on the first call

  • Some customers withhold tax on our invoices and others do not.
  • We have engineers in three countries and one corporate entity.
  • Our contracts were written domestically and we now sell globally.

If any of that sounds familiar, it is because it is the standard experience of anyone in this position. The rules were not written to be read together, and nobody is given a map. See also deemed resident vs factual resident.

Worked through with figures

The same point, with figures rather than adjectives.

Equity that vests after the move

A grant worth C$101,000 at vest, over a 48-month vesting period, 7 months of which were worked in the first country and 41 in the second.

Equity that vests after the move
ItemAmount
Value at vestC$101,000
Vesting period (months)48
Months worked in the first country7
Months worked in the second country41
Apportioned to the first countryC$14,729
Apportioned to the second countryC$86,271

Two countries tax slices of one gain: C$14,729 and C$86,271 on this apportionment. Where their taxing points differ — grant, vest, exercise or sale — the credit can arrive in a year the other country is no longer taxing, which is the mismatch to plan around. The shape of that result holds; the size of it depends entirely on your own numbers and dates.

These amounts illustrate the mechanism only. The rates and thresholds are assumptions of the example, not your numbers: each is checked against the issuing authority for your specific tax year before any return is filed.

Worked through with figures

Put numbers against it and the shape of the answer is obvious.

Credit relief on one stream of income

Take C$116,000 of income taxed in both countries. Assume the other country charged 27% on it and the home country would charge 39% on the same amount.

Credit relief on one stream of income
ItemAmount
Income taxed in both countriesC$116,000
Tax paid abroad (assumed 27%)C$31,320
Home tax on the same income (assumed 39%)C$45,240
Credit available (lesser of the two)C$31,320
Home tax still payableC$13,920

The credit absorbs C$31,320 and leaves C$13,920 payable at home, because the home rate on this income is the higher of the two. The balance is real cash and it is due on the home timetable, which is why instalments get raised in the first meeting. We run this on your actual numbers before advising anything, because the conclusion can invert with a modest change in inputs.

Illustrative figures, not a client engagement: the amounts are chosen to make the mechanism legible, and the rates and thresholds are assumptions stated for the example only. We confirm every one of them against the issuing authority for your own tax year before anything is filed.

From first call to filed

  1. 1A call to the 24-hour helpline to find out whether this is a filing or a project
  2. 2A fixed fee for a written scope — re-quoted if the scope changes, never invoiced silently
  3. 3Preparation against the evidence, with the positions documented as we go
  4. 4Your approval, then the filing — in that order
  • A change of scope is re-quoted before the work, never added to the invoice after it.
  • Documents move through an access-controlled portal rather than email.
  • Your existing accountant keeps the domestic file; we take the cross-border piece, with the boundary in writing.

How to get this moving

Bring last year's returns and we will tell you what is missing.

Where international tax accountant comes into this file

Readers arrive here searching for international tax accountant, and technology & SaaS: your filing calendar is what the page is about. Below: who it catches, what has to be filed, and what it costs — quoted in writing, before anything is done.

How the engagement runs, phase by phase

  1. Upload the file as it stands

A secure link arrives after the first call. Incomplete is fine; that is what the review is for.

  2. The number is settled up front

Priced from your own documents and confirmed in writing before any preparation begins.

  3. Both returns on one desk

One engagement covers every country the file touches, reconciled line against line.

  4. Your approval, then the filing

The return is yours to check first. We file once you say so.

The vocabulary this page leans on

Resident contributor
A person resident in the country who transferred or loaned property to a foreign trust — which is enough to make the trust deemed resident under some rules.
183-day rule
The common shorthand for a treaty employment article's presence test. There is no single rule — each treaty measures its own period on its own basis.
Forced heirship
Rules in some legal systems reserving part of an estate for particular heirs, which can override a will drafted elsewhere.
Fixed place of business
The classic form of permanent establishment: premises, equipment or a facility at the enterprise's disposal through which business is carried on.

The published fees closest to technology & saas your filing calendar

Before a calendar can be kept, it has to be caught up. What decides the fee in this band is how many periods a SaaS business is behind on, and whether the underlying records were kept per jurisdiction or have to be separated out now, year by year.

Why choose Legal Quotient for technology & saas your filing calendar

Filed with the authority, not just prepared

The engagement runs to submission and to the correspondence that follows it, including the queries that arrive months later.

Residence is tested, not assumed

Where you are resident for treaty purposes is a question with a method. We work through it and write down the answer, with the facts it rests on.

The quote comes from your documents

Nothing is priced from a phone call. We read what you have first, then the fee is set — so the scope and the number are agreed on the same evidence.

Late and missed years are ordinary work

An unfiled history is not a reason to wait longer. We assess what is still open and what relief the delay attracts before the first return goes in.

Step 2

Step 3

Step 4

Filing and payment

Nothing is filed until you have read it

The engagement, start to finish

  • Step 1: Documents first, questions second – We read the file before asking anything, so the questions we do ask are the ones that matter.
  • Step 2: A quote you can hold us to – Fixed in writing against a defined scope. No hourly meter, and no revision after the fact.
  • Step 3: The order of filing decided deliberately – Which return goes first can decide whether relief is available at all. That is planned, not discovered.
  • Step 4: Nothing filed without your sign-off – You see the completed work, ask what you need to, and approve it before submission.

Quoted up front, in writing.

Wintering in the US Long Enough to Become a US Filer

A Retirement Plan That Grows Tax-Deferred in Only One Country

Cross-border retirement accounts are recognised by treaty, but the deferral usually has to be elected rather than assumed. The engagement checks whether the election was made, makes it where it was missed, and reports the account on whichever side requires it.

Two Passports, Two Returns, One Income

Dual citizenship does not let you choose which country taxes you. The work is establishing residence, applying the treaty article that governs each income type, and preparing both returns from one set of figures so they agree line for line.

Never Filed a US Return — and Only Just Found Out

Withholding Reduced by the Right Article

Core International & Cross-Border Tax Services

International Tax Planning & Advisory

Strategy and compliance for income, assets and families spread across borders.

One coordinating team: filings on every side of the border are sequenced so treaty relief and foreign tax credits are claimed once — and in the right country.

U.S. & Cross-Border Tax Returns

Dual filers: U.S. citizens in Canada and Canadians with U.S. income run two parallel systems — we prepare both, in the right order, every year.

Expat & Emigration Tax

The move year is its own project: the elections and valuations filed that year decide the next decade of both countries’ returns.

Non-Resident Canadian Tax

Default withholding is 25% of gross: elective returns routinely turn over-withheld rent and pensions into refunds.

Transfer Pricing & BEPS

Documentation prepared with the return is the cheapest insurance in international tax; reconstructing it during an audit is the most expensive.

Cross-Border Estates & Trusts

Wills drafted for one country routinely misfire in the other — deemed disposition here, estate tax there, credits in between.

Cross-Border Corporate Tax

Expansion raises the same four questions every time — entity, PE, repatriation, payroll. We answer them before the tax authorities do.

India Tax for NRIs & Returning Residents

The deduction is taken on the sale price, not the gain — which is why an NRI property sale strands cash unless the certificate is applied for before closing.

Canadian Tax with a Foreign Element

Residency is decided on facts, not on a form — and the year you arrive or leave is the one where the largest amounts turn on the smallest details.

UAE Tax for Expats & Their Home Country

A zero-tax country is only half the answer — the question that decides the bill is whether the country you came from still treats you as resident.

Firms and partners working across borders meet Regulation 105 withholding, PE risk on long engagements and per-country payroll for travelling staff.

A partnership is taxed in the hands of its partners, so one engagement abroad can reach every partner's personal return. The order matters: the waiver is applied for before the invoice, the presence is tracked before it becomes an establishment, and the payroll is registered before the first day worked in the other country.

Technology & SaaS — your filing calendar — questions we are asked

What makes technology & saas different from an ordinary filing?

Software and subscription revenue is characterised differently across jurisdictions — as services, as royalties, or as a digital supply — and the characterisation changes both withholding and indirect tax. An ordinary preparer applies the general rule and stops there, which is how the relief in the specific provision goes unclaimed.

Can you work with my existing accountant?

That is how most of these engagements run. They keep the domestic file, we take the cross-border piece, and the boundary is agreed in writing so nothing is done twice or missed.

How much foreign income is tax-free in Canada?

None of it is tax-free for being foreign. A Canadian resident is taxed on worldwide income, so foreign salary, interest, dividends, rent and gains all go on the return, converted to Canadian dollars. What genuinely reduces the bill is the basic personal amount, the credit for foreign tax already paid, and any treaty article that exempts a specific type of income. The reporting thresholds people have in mind — the foreign property statement, for one — govern reporting, not exemption. See the foreign tax credit.

I have not filed for several years while living abroad — what are my options?

Both countries have routes back, and using one before they contact you is what preserves the relief. On the US side there are procedures aimed at taxpayers whose failure was not wilful, including one designed for people living outside the country, and separate procedures for late account reports and information returns alone. Canada has its voluntary disclosures programme and taxpayer relief for penalties and interest. Filing quietly and hoping is the one approach with no protection attached to it. See catch-up filing.

What is the most common thing you find on a review?

An unclaimed foreign tax credit, a missed information return, and a treaty position taken without the disclosure the rules required. Usually all three.

Can you handle a fourth country?

We coordinate with a local adviser there and keep ownership of the interaction between the systems, which is where the value and the risk both sit.
