New Zealand in 60 words

New Zealand has run transitional-resident rules for new arrivals whose foreign income is temporarily outside the charge, so the arrival date sets a window that has to be identified before foreign assets are restructured. Expats moving through New Zealand usually arrive with two live filing obligations rather than one, and the first job is working out which of them residence actually keeps open.

Who we act for here

Canadians, Americans and NRIs who emigrated to New Zealand, and New Zealanders resident in Canada with property back home.

Regional filing pattern

A mid-year local year against a calendar home year means every credit claim starts with an apportionment before any arithmetic.

The question that decides it

New Zealand has run transitional-resident rules for new arrivals whose foreign income is temporarily outside the charge, so the arrival date sets a window that has to be identified before foreign assets are restructured.

Working remotely from New Zealand

This page takes the New Zealand corridor and narrows it to one situation. The general position is on the New Zealand country guide; what follows is what changes for this specific case.

Working from New Zealand does not make your employer's income foreign, and it does not make your own income exempt. Tax follows where the work is performed, which means the country the laptop is in has a claim regardless of where the logo is.

Working remotely from New Zealand — priced before we start

Working remotely from New Zealand is priced on who pays you and from where: one foreign employer and one home return is straightforward, while a contract split across two payrolls, or a company weighing whether your desk creates a presence here, is a wider piece of work. The fee is agreed in writing first.

Do you still file at home?

Which system claims you decides everything else. Canada looks at ties and stops taxing worldwide income when they genuinely end. The United States looks at the passport and never stops. India looks at days, and holds a transitional category for people whose recent history was spent abroad.

New Zealand has run transitional-resident rules for new arrivals whose foreign income is temporarily outside the charge, so the arrival date sets a window that has to be identified before foreign assets are restructured.

Residency and the tie-breaker

Overlapping residence is resolved by an ordered treaty test rather than by whoever assesses first. Identifying which test will decide the case, early, is most of the work.

We confirm the treaty in force for your year, including any protocol and any modification made through the multilateral instrument, before relying on an article. Treaty networks change, and a summary written three years ago is not evidence about this year.

Income by type: who taxes what

How each income type is treated in this corridor
Income typeGeneral treatment
Employment equity (options, units)Sourced across the period between grant and vest, so two countries can tax slices of one gain.
Self-employment and professional feesTaxable where the business is carried on; a treaty limits the source country to profits attributable to a permanent establishment.
Scholarships, grants and trainee paymentsOften exempted for a limited period from arrival under the students-and-trainees article, claimed by filing rather than automatically.
Employment incomeGenerally taxable where the work is physically performed, with a treaty exemption for short assignments where the presence, employer and cost tests are all met.
Local partnership or LLP shareTaxable where the business is carried on, but whether your home country sees the entity as transparent decides in which year it taxes you.
Pensions and retirement incomeDecided by the specific pension article, which is the least uniform provision in the treaty network.
Gain on selling your former home at homeThe relief that exempted it while you lived there is usually time-limited once you leave, and the clock is not always the one people expect.

The local nuance

New Zealand has run transitional-resident rules for new arrivals whose foreign income is temporarily outside the charge, so the arrival date sets a window that has to be identified before foreign assets are restructured. None of that is exotic, but it is corridor-specific — and corridor-specific detail is what a template answer cannot supply.

The numbers, end to end

Here is the rule doing its work on an actual set of amounts.

Credit relief on one stream of income

Take C$173,000 of income taxed in both countries. Assume the other country charged 18% on it and the home country would charge 42% on the same amount.

Credit relief on one stream of income
ItemAmount
Income taxed in both countriesC$173,000
Tax paid abroad (assumed 18%)C$31,140
Home tax on the same income (assumed 42%)C$72,660
Credit available (lesser of the two)C$31,140
Home tax still payableC$41,520

The credit absorbs C$31,140 and leaves C$41,520 payable at home, because the home rate on this income is the higher of the two. The balance is real cash and it is due on the home timetable, which is why instalments get raised in the first meeting. Change any one of those inputs and the answer moves, which is why we run it on your own figures rather than on an illustration.

These amounts illustrate the mechanism only. The rates and thresholds are assumptions of the example, not your numbers: each is checked against the issuing authority for your specific tax year before any return is filed.

What we fix most often

  1. Treating a bank's tax-residence questionnaire as the answer rather than as a question, and certifying a status that the filings then contradict.
  2. Assuming the move ended the home-country obligation. Residence ends when the ties end, and a home kept available or a family left behind usually keeps it alive.
  3. Treating a residence permit or a visa category as a tax answer. Immigration status and tax residence are decided by different tests.
  • Rated 5.0 out of 5 stars on Google, on a profile open for you to read.
  • Every statutory figure in your file is verified for your own year at source.
  • We will tell you when you do not need us, and that call is free.

Ask before the move rather than after it, because most of the useful options expire on the date.

Where taxes for expats comes into this file

This is the page to read on taxes for expats. It takes working remotely from New Zealand in order — the test that decides who is affected, the returns and forms that follow from it, and a fee quoted in writing before anything starts.

The four phases of the work

  1. Tell us the dates and we will tell you the position

Arrival, departure, the years in between — the residence question turns on those before anything else.

  2. Fixed fee, defined scope, in writing

Both agreed before work starts, so the engagement cannot grow into a larger bill.

  3. Prepared together, not passed between firms

You are not the go-between for two sets of advisers working from two sets of assumptions.

  4. Reviewed, approved, filed

A named practitioner checks it, you approve it, and then it goes.

The difference a dedicated cross-border team makes

Factor Legal Quotient Hourly billing model
Pricing A fixed fee, agreed in writing before work starts Hourly, billed as incurred
Experience 15+ years of cross-border work, 18,000+ clients Varies by file
Both sides of the border Prepared together by one team, so relief is claimed exactly once One country at a time, reconciled later
Who reviews it A named practitioner, published on the page Whoever the queue reaches
Where the work happens Our offices in India, the USA, Canada and the UAE Whichever single office you can travel to

Four terms worth pinning down

Tax residency certificate
The certificate from a treaty partner's authority that India requires before granting treaty relief, for the right period and in the right name.
Form 3520
The US return reporting transactions with foreign trusts and the receipt of large foreign gifts and bequests — an obligation missed precisely because the receipt is not income.
Engagement letter
The document setting the scope, the fee and the boundary with any other adviser. In a cross-border file the boundary is the important part.
Taxable surplus
A pool of foreign affiliate earnings whose distribution to Canada attracts Canadian tax with a deduction for underlying foreign tax.

The published fees closest to working remotely from New Zealand

A second factor is what your departure left open. If the country you left still treats you as resident, two returns have to be reconciled rather than one, and an arrival date falling inside the transitional window for new residents changes what needs reporting in the early years.

What working with us on working remotely from New Zealand looks like

One team, not two firms billing separately

You are not the go-between for two sets of advisers with two sets of assumptions. One engagement covers each country the file touches.

Every figure on a page is traceable

Where a rate or a threshold appears in our writing it names the tax year it belongs to. Where it could not be confirmed, the page describes the mechanism and quotes no number.

Late and missed years are ordinary work

An unfiled history is not a reason to wait longer. We assess what is still open and what relief the delay attracts before the first return goes in.

What these engagements turn on

Case study 1

Canadian Pension Paid Abroad and Taxed at the Flat Rate

Pension and annuity payments to a non-resident carry a flat withholding that often exceeds what a return would produce. The alternative filing is elective, and whether it helps depends on the total income for the year rather than on the payment alone.

Case study 2

Paying a Dividend Up to a Foreign Parent

The withholding rate depends on the treaty, on the size of the holding, and on whether the parent is the beneficial owner rather than a conduit. Establishing all three before the payment is what secures the lower rate at source.

Case study 3

The Same Income Taxed Twice on Paper

Relief usually exists and is lost to sequence: one country taxes at source and the other credits it, and preparing them in the wrong order claims a credit against a figure nobody has computed.

Case study 4

Two Passports, Two Returns, One Income

Dual citizenship does not let you choose which country taxes you. The work is establishing residence, applying the treaty article that governs each income type, and preparing both returns from one set of figures so they agree line for line.

Case study 5

One Salesperson Abroad, and a Corporate Filing Obligation

A single employee with authority to conclude contracts can create a taxable presence for the whole company. The review tests what the person actually does against the treaty article, and where a presence exists, works out what profit is attributable to it.

Social Security Contributions Owed in Two Countries at Once

A totalization agreement assigns contributions to one system and exempts the other, but only against a certificate obtained in advance. Without it both sets come out of the same salary and neither is straightforward to recover.

Case study 7

A Student or Researcher Covered by a Treaty Article

Several treaties carry a dedicated article for students, trainees and visiting researchers that displaces the ordinary employment rules. Whether it applies turns on the purpose of the stay and the source of the funds, both of which are evidenced rather than asserted.

Indian Transfer Pricing Certification With a Hard Deadline

An Indian entity with international related-party transactions needs an accountant's report filed by a date of its own, ahead of the return. The work is reconciling the transactions to the books first, because the report is only as defensible as that reconciliation.

Core International & Cross-Border Tax Services

International Tax Planning & Advisory

Strategy and compliance for income, assets and families spread across borders.

One coordinating team: filings on every side of the border are sequenced so treaty relief and foreign tax credits are claimed once — and in the right country.

U.S. & Cross-Border Tax Returns

Dual filers: U.S. citizens in Canada and Canadians with U.S. income run two parallel systems — we prepare both, in the right order, every year.

Expat & Emigration Tax

The move year is its own project: the elections and valuations filed that year decide the next decade of both countries’ returns.

Non-Resident Canadian Tax

Default withholding is 25% of gross: elective returns routinely turn over-withheld rent and pensions into refunds.

Transfer Pricing & BEPS

Documentation prepared with the return is the cheapest insurance in international tax; reconstructing it during an audit is the most expensive.

Cross-Border Estates & Trusts

Wills drafted for one country routinely misfire in the other — deemed disposition here, estate tax there, credits in between.

Cross-Border Corporate Tax

Expansion raises the same four questions every time — entity, PE, repatriation, payroll. We answer them before the tax authorities do.

India Tax for NRIs & Returning Residents

The deduction is taken on the sale price, not the gain — which is why an NRI property sale strands cash unless the certificate is applied for before closing.

Canadian Tax with a Foreign Element

Residency is decided on facts, not on a form — and the year you arrive or leave is the one where the largest amounts turn on the smallest details.

UAE Tax for Expats & Their Home Country

A zero-tax country is only half the answer — the question that decides the bill is whether the country you came from still treats you as resident.

A partnership is taxed in the hands of its partners, so one engagement abroad can reach every partner's personal return. New Zealand — questions we are asked

Do I have to file at home while living in New Zealand?

For most people the answer turns on whether the ties that made them resident have actually ended. For a US citizen or green-card holder it does not: the return is due in New Zealand exactly as it would be at home. Everything else on the file follows from which of those you are.

Is there a treaty between my country and New Zealand?

That is verified rather than assumed: we confirm which treaty text governs New Zealand and your home country for the year in question, because a protocol can move a rate or an article between years. If there is no treaty, unilateral credit rules are what prevent double taxation.

I own property in New Zealand. Where is the rent taxed?

Where the property is. That is close to universal, and it usually arrives as withholding on the gross rent rather than as a return on the profit — which is why the election onto a net basis, where New Zealand offers one, is normally the first thing to check. Your home country taxes the same rent and credits what was paid.

I work remotely from another country for a company back home — who taxes me?

Usually the country you are physically in, because employment income is generally sourced where the work is done, with your residence country taxing it as well if you are resident there and giving credit. Three things follow: your employer may acquire withholding and social security obligations where you sit, a treaty tie-breaker may be needed if both countries call you resident, and a short trip that becomes a long stay can cross a residence threshold nobody was watching. See remote workers and digital nomads.

Is my foreign pension taxable?

Usually in at least one country, and which one depends on the treaty article covering pensions — some give the taxing right to the country paying it, others to where you live, and several treat government service pensions differently again. Withholding at source is common and often reducible by treaty, with an elective return recovering an over-deduction. See the pensions article.

Does dual citizenship affect Social Security benefits?

Entitlement is built on your contribution record and on the rules of the paying system, not on how many passports you hold. What your citizenship and residence do affect is the tax side: which country may tax the benefit under the treaty's pensions or social security article, whether the payer withholds, and whether a totalization agreement joins two contribution records to get you over an eligibility threshold. See totalization agreements.
