The short answer

A foreign employer with one employee working in Canada owes Canadian payroll withholding on those workdays, and the employee's exemption under the treaty does not remove the employer's obligation. Registration, source deductions and reporting follow the place of work.

Do you need this?

  • A relocation package was agreed without modelling it after tax
  • An employer-of-record provider handles payroll and nobody has tested the presence risk
  • A home-country payroll is still running for someone who has moved
  • An employee works in a country your payroll does not cover
  • Someone is on assignment, secondment or a rotational schedule

If more than one of those is true, this is your page. If none of them is, tell us on a call and we will point you at the right one — that happens often enough that we would rather you asked.

Transparent, fixed pricing for payroll for a foreign employee in Canada

What decides the fee for a foreign employer with someone working in Canada is whether payroll relief is arranged in advance or the obligation has already been missed. A waiver or qualifying non-resident employer certification obtained before the first Canadian workday is one engagement; registering late, with source deductions and reporting owed for days already worked, is another.

What the rule does, step by step

A foreign employer with one employee working in Canada owes Canadian payroll withholding on those workdays, and the employee's exemption under the treaty does not remove the employer's obligation.

Registration, source deductions and reporting follow the place of work. Relief comes through a waiver or a qualifying non-resident employer certification, both arranged in advance, and social security follows the totalization agreement rather than the treaty.

Two things follow from that. The first is that the outcome is decided by facts you can arrange and evidence you can keep, rather than by how the return is completed at the end of the year. The second is that sequence matters: the same steps taken in a different order can produce a materially different result, which is why the first conversation is about dates and documents rather than forms.

Every statutory figure that reaches your file is checked against the authority that issues it, for the year in question, before anything is filed. Where we cannot verify a number for your year, the advice explains the mechanism instead and says so plainly, because an unverified threshold is a liability rather than a shortcut. See also tax for product & project managers and tax for auditors & accountants abroad.

What we actually file

  • Day-count records assembled from travel data
  • Year-end reconciliations between the two payrolls
  • Host and home payroll registrations and returns
  • Waivers and certifications that remove withholding where a treaty applies
  • Certificates of coverage for social security

The arithmetic, worked through

Here is the rule doing its work on an actual set of amounts.

Splitting one salary between two countries

A salary of C$219,000 for a year with 245 working days, 81 of them performed in the other country. Employment income is generally sourced to where the work was physically done.

Splitting one salary between two countries
ItemAmount
Annual salaryC$219,000
Working days in the year245
Days worked in the other country81
Days worked at home164
Income sourced to the other countryC$72,404
Income sourced at homeC$146,596

C$72,404 is sourced abroad on this split, which is the figure the host country taxes and the figure the home credit is computed on. Reproduce this from a travel record, not from memory — it is the first thing an auditor asks for. The shape of that result holds; the size of it depends entirely on your own numbers and dates.

Illustrative figures, not a client engagement: the amounts are chosen to make the mechanism legible, and the rates and thresholds are assumptions stated for the example only. We confirm every one of them against the issuing authority for your own tax year before anything is filed.

What working with us looks like

  1. 1A call to the 24-hour helpline to find out whether this is a filing or a project
  2. 2A fixed fee for a written scope — re-quoted if the scope changes, never invoiced silently
  3. 3Preparation against the evidence, with the positions documented as we go
  4. 4Your approval, then the filing — in that order

What you pay, and when

Fees for payroll for a foreign employee in Canada are quoted as a fixed amount for a defined scope. There is no hourly meter and no surprise on the invoice: the number is agreed in writing before anything starts. Comparable engagements and their fixed fees are set out on the pricing pages.

  • Every statutory figure in your file is verified for your own year at source.
  • 18,000+ clients served across 4 global offices: India, the USA, Canada and the UAE.
  • Rated 5.0 out of 5 stars on Google, on a profile open for you to read.

Your next step

We would rather scope it properly than quote it quickly. The fastest start is a short call and three things: what happened, when it happened, and which countries are involved. Everything else we can ask for as it comes up.

Registration, source deductions and reporting follow the place of work.

Whatever the file turns out to involve, the terms do not move: the scope and the fee are agreed in writing before any work starts, a named practitioner reviews the result, and nothing is filed until you have approved it.

Headcount and the length of each stay then set the scale, and social security is quoted separately because the totalization agreement rather than the treaty governs contributions — a certificate may be needed for each person. Every part of it is priced in writing before any filing is prepared.

The difference a dedicated cross-border team makes

Late and missed years are ordinary work

An unfiled history is not a reason to wait longer. We assess what is still open and what relief the delay attracts before the first return goes in.

The quote comes from your documents

Nothing is priced from a phone call. We read what you have first, then the fee is set — so the scope and the number are agreed on the same evidence.

Residence is tested, not assumed

Where you are resident for treaty purposes is a question with a method. We work through it and write down the answer, with the facts it rests on.

The order of filing is planned, not improvised

Which return goes first decides whether relief can be claimed at all. That sequence is worked out before anything is submitted.

What these engagements turn on

Case study 1

Paid for Work Done in Canada While Living Elsewhere

Employment carried out in Canada is taxable here even where the employer and the bank account are not. The engagement establishes how many of the days were worked in Canada, applies the treaty employment article, and deals with the withholding the payer has already taken.

Read how this one runs
Case study 2

A Relief That Turned on Days Nobody Had Recorded

Treaty exemption, residence and social security are each decided by a count that has to be evidenced rather than recalled. The engagement builds the record from tickets, rosters and payroll before applying any article.

Case study 3

Social Security Contributions Owed in Two Countries at Once

A totalization agreement assigns contributions to one system and exempts the other, but only against a certificate obtained in advance. Without it both sets come out of the same salary and neither is straightforward to recover.

Case study 4

Options Granted in India and Exercised Elsewhere

Where the grant, the vesting and the exercise happen in different countries, each may claim part of the same gain. Apportioning it across the period worked is what prevents the whole amount being taxed twice.

Case study 5

A Student or Researcher Covered by a Treaty Article

Several treaties carry a dedicated article for students, trainees and visiting researchers that displaces the ordinary employment rules. Whether it applies turns on the purpose of the stay and the source of the funds, both of which are evidenced rather than asserted.

Case study 6

Fifteen Per Cent Held Back From a Fee for Services in Canada

A payer must withhold from fees paid to a non-resident for services rendered in Canada, whether or not any tax is ultimately owed. A waiver applied for before the work is invoiced avoids the withholding; after it, the money comes back through a return.

Case study 7

Green Card Kept, Moved to Canada — Both Returns Still Due

Holding a green card does not end the US filing obligation, and living in Canada starts a Canadian one. The engagement fixes residence under the treaty tie-breaker, then decides which return the relief is claimed on so the two do not contradict each other.

Case study 8

Documentation Requested, and the Deadline Is Not Extendable

Contemporaneous documentation has to exist by the filing deadline, not be assembled when it is asked for, and the penalty protection turns on that timing. The engagement produces the analysis for the year in question and puts a repeatable process behind the next one.

Core International & Cross-Border Tax Services

International Tax Planning & Advisory

Strategy and compliance for income, assets and families spread across borders.

One coordinating team: filings on every side of the border are sequenced so treaty relief and foreign tax credits are claimed once — and in the right country.

U.S. & Cross-Border Tax Returns

Dual filers: U.S. citizens in Canada and Canadians with U.S. income run two parallel systems — we prepare both, in the right order, every year.

Expat & Emigration Tax

The move year is its own project: the elections and valuations filed that year decide the next decade of both countries’ returns.

Non-Resident Canadian Tax

Default withholding is 25% of gross: elective returns routinely turn over-withheld rent and pensions into refunds.

Transfer Pricing & BEPS

Documentation prepared with the return is the cheapest insurance in international tax; reconstructing it during an audit is the most expensive.

Cross-Border Estates & Trusts

Wills drafted for one country routinely misfire in the other — deemed disposition here, estate tax there, credits in between.

Cross-Border Corporate Tax

Expansion raises the same four questions every time — entity, PE, repatriation, payroll. We answer them before the tax authorities do.

India Tax for NRIs & Returning Residents

The deduction is taken on the sale price, not the gain — which is why an NRI property sale strands cash unless the certificate is applied for before closing.

Canadian Tax with a Foreign Element

Residency is decided on facts, not on a form — and the year you arrive or leave is the one where the largest amounts turn on the smallest details.

UAE Tax for Expats & Their Home Country

A zero-tax country is only half the answer — the question that decides the bill is whether the country you came from still treats you as resident.

Payroll for a foreign employee in Canada — questions we are asked

Payroll for a foreign employee in Canada — can I handle this myself?

Some of it, yes — and we will say so on the call if that is the honest answer. The parts that are worth paying for are the ones where a missed election, a missed deadline or an unverified threshold costs more than the fee: registration, source deductions and reporting follow the place of work.

What if I have already filed and got it wrong?

That is a common starting point. We re-derive the position, identify whether an amendment or a disclosure route is the right vehicle, and tell you which one preserves the relief that is still available. The order matters more than the speed.

How long will it take?

It depends on the documents rather than on us. Once the pack is complete most filings turn around inside a fortnight; anything that needs a certificate from a tax authority runs on that authority's timetable, which we tell you at the start rather than at the end.

How many days can I spend in a country before I become tax resident?

It depends on the country, and a day count is only ever the start. Many use a threshold in a tax year, some also look at averages across several years, and some have no day test at all and decide on where your home and life are. Two countries can both conclude you are resident, which is what the treaty tie-breaker exists to settle. Counting days without checking the tie-breaker is how people end up filing as resident nowhere. See the residency tie-breaker.

Is "fund transfer pricing" the same thing as transfer pricing?

No — and if you came here to calculate FTP, this is not it. Fund transfer pricing is a bank's internal allocation of funding costs and benefits between its own business units, a treasury and asset-liability management discipline used to measure branch or product profitability. Tax transfer pricing is about prices between legally separate related parties across borders, and about which country taxes the resulting profit. The words overlap; the fields do not. See our transfer pricing work.

Can an accountant in one country file my return in another?

Yes, where they are authorised to represent you with that tax authority and the filing is done electronically. What matters is not where the adviser sits but whether they can lawfully act for you and are competent in both systems — a return prepared with no knowledge of the other country is where the relief gets missed. We file on both sides, from offices in India, the USA, Canada and the UAE. See how we work.

What if I am behind on filings?

That is a routine engagement rather than an unusual one. We map the unfiled years and obligations first, then advise which catch-up route is open before anything is filed — the order matters more than the speed.

What happens after the filing?

You get the filed copies and a note of anything due next year, with the dates. Where an authority responds, that correspondence comes to us if the authorisation is in place.

No hourly billing, ever
